Police have banned the planned anti-government protests by the Azimio la Umoja One Kenya coalition in Nairobi on Tuesday.
Speaking during a media briefing on Sunday, Nairobi Regional Police Commander Adamson Bungei acknowledged that the opposition submitted a notice to hold demonstrations in the streets of Nairobi.
However, Bungei said the Raila Odinga-led political outfit will not be allowed to hold the protests, claiming they have failed to demonstrate goodwill in previous demonstrations.
The police commander noted that the opposition did not meet the threshold of peaceful protests stipulated in Section 37 of the constitution and Section 5 of the Public Order Act.
“As much as you are allowed by article 37 (to protest) there is also subsection 5 of the same that allows the police to regulate the same procession,” he said.
“Assemblies which are not peaceful are excluded from protection of the article. Once you do not meet the requirements of section 5 then we have the mandate to ensure that it is regulated and managed.”
He added that previous demonstrations were marred with violence as the demonstrators were armed with machetes and attacked members of the public, resulting in the destruction of public property and loss of lives.
“By this, we are declining to allow the Azimio team the go-ahead to proceed with the demonstration and any such demonstration will be dispersed by law enforcement officers. This indicates very clearly to Kenyans of goodwill that there will be no demonstrations in the city of Nairobi.”
Azimio announced it would resume weekly protests, citing the Kenya Kwanza administration’s failure to commit to holding constructive bipartisan talks.

The police in Kenya should not allow a man who does not know the meaning of the word democracy tell them what to do especially when it comes to political demonstrations. The human being who does not understand what the concept of democracy means is Kipchirchir Samoei. Last week the former President of Kenya warned the police officers to stop allowing themselves to be used merely for political purposes by the resident of our State House.
HOW COME?
Samoei should study the politics of democracy in the United States of America. Why? In 2020, when President Donald Trump lost the presidential election, he did not remain silent. He went to the courts and miserably failed. That was not the end of his attempt to win the presidency. He organized a protest on January 06, 2021 and stormed the Capitol Building. The purpose of the Capitol invasion was to stop the process of certification of President-Elect Joe Biden from being confirmed as the next president of the USA. In the process, a few people lost their lives.
Throughout President Joe Biden’s term in office, Donald Trump has not stopped protesting, criticizing, and holding political meetings throughout the US. Has President Biden sent the police to stop Donald from holding these meetings? NO!
We all know that Samoei opposed the current constitution of Kenya. I wonder whether he has taken time to read it? I honestly doubt it.
I therefore ask the current members of parliament to convene an urgent meeting and immediately start the process of impeaching Samoei. This should be done immediately just before Samoei takes us back to the sad days of the late President Kipkorios Toroitich. He needs to resign from the office of the Kenyan presidency. When? Right now.

My friend, its a sad commentary to use a character like Donald Trump to justify Raila’s violent demonstrations that loot supermarkets and destroy businesses in Kenya- even after a unanimous decision by our Supreme Court in regard to last year’s elections. And if you are using US as the model, why not use president Abraham Lincoln’s statement at the onset of the Civil War in 1861,that threatened to tear America apart: “popular Democracy is based on consent and free elections, the result of which cannot be challenged by the use of violence. To allow resort to force, after the votes have been freely cast, would be to destroy the very foundations of democracy:” when ballots have fairly and constitutionally decided, there can be no successful appeal back to violence(bullets)” (Ref:The genius of America, Saul K. Padover” How can we believe and trust a whistleblower that has remained in hiding and not our constitutional process even if not perfect. If Chebukati was such a disaster for our elections, how come the election of all other elected offices: MPs, governors, MCAs etc., went smoothly under the same IEBC with those individuals happily serving in their elected offices today? There is no such a thing as perfect elections anywhere in the world. For the sake of the people, country, and national security, losers decide to wait another day even when they doubt that they lost.

I ask you politely not to forget the activities that took place in Washington, D.C. on January 06, 2021. On this day, a few innocent people lost their lives while in the process of going along with Donald Trump’s claim that the US election was rigged.
Demonstrations are part and parcel of the construct known as “democracy.” Samoei must have the courage to learn that our New and cherished Constitution allows demonstrations to take place. That is why many sacrifices were made during the Second Liberation of Kenya. Unfortunately, neither Rigathi nor Samoei made any personal sacrifices or contributions during that hour of need. During that time, many people were arrested, tortured in Nyayo House and a few lost their lives in order to make it possible for demonstrations to take place without police interferences.
I still wonder why we are quick to ape systems developed elsewhere without using our own brains to come up with our own original economic, and political systems.
Do you think it is fair and rational that in Kenya, a nation composed of over 40 micro nations has had only two of them in power as presidents since 1963? We need to get rid of “democracy” in Kenya as we know it today.
