Businessman Sues Credit Reference Bureau (CRB) Demanding Sh22 Million Compensation for Wrongful Listing

A businessman has sued the Credit Reference Bureau (CRB) for wrongful blacklisting.

David Sila Onyango accuses CRB of negatively listing him over an alleged loan of $2.1 million (Sh227 million) which resulted in him being denied credit by a local lender.

In his petition, Sila says he applied for a Sh30 million loan from Co-operative Bank on October 2nd, 2020, but the application was declined due to a negative listing by CRB.

He further notes that despite demanding the particulars of the alleged debt that resulted in his blacklisting from TransUnion from September 2020, the firm has ignored his emails and a demand letter from his attorney.

Through his lawyer Fred Orago, Sila insists he has never borrowed a loan amounting to $2,187,218.03 as set out in CRB’s Consumer Report.

“Despite the defendant (CRB) being duly notified of the incorrect negative listing, it has not taken any steps to delete the said listing or otherwise provide the particulars of the said listing,” court documents read.

“In consequence of the said wrongful listing, I have been gravely injured in my credit, reputation, character, and standing as a person in the way of my occupation and profession as an astute businessman and now I am unable to get any credit from registered establishments.”

Sila, a businessman in the freight and logistics industry, is seeking Sh22.3 million in compensation from CRB, and a permanent injunction restraining CRB from negatively listing him.

The case will be mentioned on September 20th, 2021.

    Do Credit Bureaus make that kind of mistake, listing a defaulted loan that never existed? This guy does not know that some tricks only work in Kenya. It is likely that he guaranteed a loan for someone else, who defaulted, and is now trying to abscond responsibility by saying that he is not the one who took the loan. A Credit Bureau is just a platform for lenders to list borrowers, their guarantors, and update it as payments are made. The only person who can be taken to Court is the person who gave the loan, and listed it as defaulted with the CRB.
