Petition Filed to Block Ruto’s Swearing-in If Elected President

11 petitioners have moved to the Supreme Court seeking to stop the swearing-in of UDA presidential candidate William Ruto and his running mate Rigathi Gachagua should they win the August 9th elections.

Through their attorney Kibe Mungai, the petitioners contend that the swearing-in of the two would be a violation of the Constitution as they do not pass the integrity test as enshrined in Chapter Six of the Constitution.

“Given the provisions of Chapter Six of the Constitution, swearing in of the 1st and 2nd Respondents to office will constitute a flagrant violation of Articles 3, 4 and 10 of the Constitution,” reads the petition.

“Unless and until this Honourable Court has determined the constitutionality of the registration and gazettement of the 1st and 2nd Respondents as candidates, it would amount to aiding and abetting illegalities if the Respondents are sworn into office in the event that they get elected.”

Last week, a group of activists filed a petition seeking to have Gachagua barred from contesting in the August 9th general elections. 

The petitioners want the court to determine whether Gachagua is fit and suitable to hold any public office after the High Court directed him to forfeit Sh202 million to the government after failing to justify its source.
