MP Tables a Bill to Legalize Sex Work in Kenya

A new bill seeking to decriminalize sex work in Kenya has been tabled in Parliament.

The Penal Code Amendment Bill 2021 is sponsored by Nakuru Town East MP David Gikaria and is set for the first reading in Parliament.

The bill seeks to delete Section 182 of the Penal Code which gives police the powers to arrest those engaging in commercial sex in public places, beggars, and drunkards on grounds that they are idle and disorderly. 

Gikaria, a two-time MP, argues that law enforcement officers have used the powers to harass innocent civilians.

“The Penal Code is amended by repealing Section 182. The law enforcers have often used Section 182 to harass innocent members of the public,” Gikaria states.

The Penal Code describes idle and disorderly persons as “every common prostitute behaving in a disorderly or indecent manner in any public space.”

    Before you decriminalize it shouldn’t you make it legal first? My understanding is that prostitution is illegal in Kenya despite its rampant spread.
    I have hard time calling prostitution work when the main purpose is usually for a woman to let a man ejaculate in her.Is that really work. I guess if we define work as mental and physical activity to achieve an end.In that case the man is working as well(he is a sexworker)For lack of abetter word i would call it a”contract”.
    How come in such matters the Johns are usually silent?Dont they want their rights to hookers “preserved.”
    Fortunately,or unfortunately,depending on your moral,and ethical standing,prostitution is here to stay.The best we can do for society is to make it safer for the performers/workers,and society.

    Good idea. Regulate it and tax it after all there are many prominent people who use those services to include pastors and legislators. Next legalize marijuana since it has been shown to reduce the effects of anxiety disorders in many people.
