DPP Noordin Haji Hires Top British Lawyer to Handle High-Level Cases Facing Senior State Officials

The Director of the Public Prosecutions (DPP) Noordin Haji has hired the services of a renowned British lawyer, Prof. Khawar Qureshi.

Haji says the Queen’s Counsel will specifically handle high-level corruption cases facing senior judicial and State officials.

The Office of the Director of Criminal Investigations (ODPP) says it settled on the London-based professor after failing to get a suitable candidate locally.

“Taking into account the transnational nature of the offences, the complexity and the special skills required to maintain the integrity of the process, the DPP has deemed it prudent, and has decided to appoint Khawar Qureshi, QC, and his assistants to be consultant and lead prosecution counsel on behalf of the ODPP,” the ODPP says.

“The DPP advertised for private legal counsel but due to the unique nature of requirements and the complexity of cases, it was not possible to find suitable candidates.”

Deputy Chief Justice Philomena Mwilu, a number of Governors, MPs, Principal Secretaries and several heads of State Corporations are among top government officials facing graft charges.

“In order to ensure transparency and independence in dealing with these cases, to build jurisprudence, to allow pragmatic interpretation of the Constitution and to avoid conflict between the ODPP and the Judiciary, we deem it prudent to engage private foreign counsel to deal with these matters,” Haji adds.

Prof Khawar is a former law lecturer at Cambridge University and King’s College London.

      There is no problem with Kenyan lawyers’ intellectual capability; the problem is; 1. corruption, hence, cases are compromised. 2. Outdated, ineffective and inefficient judicial system that is equivocal to a Russian Roulette. 3. Inadequate judges. 4. Transfer of judges every 2 years or so, leaving cases hanging, hence, the new judge may be forced to start everything from a fresh. 3. Backlog of cases, worst cities Eldoret and Mombasa.

    Colonization at its best. This is self loathe. The people who colonized us, stole our land, corrupted the cases of our fore fathers,hanged them without giving them a chance to present their cases, forced us to follow their God, made us slaves are the same ones we are following after 50 years of independence. Why do our people go to school? This is 100% prove that for 50 years our government has prescribed the wrong language to our people. Of all the Kenyan lawyers educated through that system we cannot find one that is capable of interpreting the law and handling these cases. Kenyans have spent millions educating those lawyers and now those lawyers are useless and cannot help Kenya in times of need. We prefer a lawyer who knows nothing about our people and country to come and decide cases in Kenya. Kenyans will pay not only for higher legal fees but transport, accommodation and some drama. What is the background of this lawyer? Kenyans need explanations of all this to justify the uselessness of legal education in Kenya. God give Kenya leaders not politicians. God help Kenya!!!

      aaaah, what do we call the tendency to repeat the same thing over and over again even when it doesn’t work? Where we can import brains and experience that we don’t have, we do…. I wish we could replace that whole judiciary and lawyers with imports, they STINK!

    So each time we encounter problems we don’t trust ourselves to solve even though wehave seemingly capable people will run to mzungu, because we trust him.When are we going to be independent.I bet most kenyans would chose a mzungu over mwafrican with similar qualifications.
    The other day I read that Gormahia soccer team has hired some foreigner to teach them soccer.Really!How about those national stars of yesteryear?Cannt they couch? In athletics we beat the whole globe with our own trainers and couches, save for very few foreigners. Mary Keitany is couched by her kenyan husband. She is the best female marathon runner.Eliud kipchoge the best male marathon ever couched by kenyan couch.I dont see why we cannt replicate this success in other areas.Failure to do so is an acknowledment of”inferiority”.
    Kenyans have been going to institutions of higher learning before independance.By now iwould think that we have cultivated enough ofour own technocrats,scientists, academicians,writers,historians you name it ,to even export some.When are we going to be truly independent.
    Let have our own lawyers adjudicate this cases .How else are we going to gause their ability?

You know one thing that is so true and I know twill get under the skin of many back Jamhuri…..yule mtu ametempea, AKASOMA NA AKAISHI (not benchmarking or tourist visit) nje in western world, hata afanye cna au awe homeless in those countries, their reasoning, their perspective, their aspirations are way way different than those who haven’t, those bench-markers and visitors.

      Again, Haji has brought bench-marking home (saved tax-payers money a notch) where those critical legal minds will see how things are done, without favour or prejudice. And that is why I say, get local lawyers to work under this guy so that they can learn a thing or two.

      Accepting that someone, mzungu au muindi (i guess QC ni naturalized) and learning from them, and they are willing to teach you, is not inferiority complex….. C’mon guys, you know better where these dancing chairs with our Kenyan Judiciary has driven and left us to this point!

Our country is rotten to the core when you come to corruption. Engineers,Lawyers, Constructors, Doctors, Judges, Brokers, Civil servants, and even the Clergy are all rotten with corruption. What a same for our republic, having to go out and hire an outsider to come clean up our mess? What have we done to ourselves within a short period of 55 years? And the shocking fact here is to realize that this hired gun will do nothing to change or alter our present predicament. In reality, there is no foreign solution to our domestic problems- and we should have known that; after almost seven years of ICC trying to get a solution to our post election violence; to this day, not a single criminal political instigator is imprison for all the sufferings and loss of life that our people went through.     Most definitely there many qualified and more experienced lawyers here in Kenya, but the son of Haji says that they would have wished to hire locally and that wasn’t possible.
    Two likely possibilities;
    1. The most suited criminal lawyers, have at some point represented the same culprits in other cases. Most high profile individuals hire the best.
    2. A local lawyer is 100 times more likely to be compromised, so as to slow or block justice.

    Those of you advocating for local solutions possibly have not experienced the frustration of seeking recourse when pursuing justice and/or essential service from the public sector. In Kenya courts, judges, prosecutors and most court employees are compromised. When you see Kidero and Waiguru laughing off any indictment, they know many in the halls of justice are in their payroll. To bring down the behemoth of corruption that plagues Kenya, courts outside the country will have to be involved. We put ourselves in this mess and there’s no internal goodwill to get us out of it.

See once the foreigners we hire have adjudicated the cases,past judgement,and left, we will go back to our local judges,right. So why not ” perfect our locals” since they are home grown. Are we not so capable of cleaning what ever needs to be cleaned so that the right judges acan rule on our cases?
      To quote professor lumumba,” sanitize” our judges.Why do we have them if we cannot use them.Some have spent millions of public money,we cannot let that go to waste.

        @Maxiley, Professor Lumumba’s record at EACC is quite dismal and I no longer listen to his so called eloquent use of the queen’s English. Short of a benevolent dictator Rwanda or Singapore style , no one in Kenya has any goodwill of ridding that country of the rot. Outside courts and personnel are giving us hope by rattling the cage a bit. It will take a while but with time some of the likes of Ruto, Kidero, Waiguru, Obado etc will pay. I even advocate the looters to be tried outside the country where there’s no possibility of bribing court personnel.

    This is a case of “fool me once, shame on you; fool me twice, shame on me”. The new sheriff in town knows the rot in the cases he is dealing with and he knows too that a new broom sweeps clean. Most of our legal experts are over-socialized and overconfident, lacking in commitment and consistency. Our faulty intuition and mental short-cuts has led to their professional ineptitude. They whitewash every wheel and dealing, leaving the justice system vulnerable to the core.
    For lack of a better scenario, if a house was on fire, who would mind who is putting out the fire? even muddy or dirty water would put out the fire regardless!
    Whatever it legally takes to slay the dragon of corruption, so be it. QC Qureshi karibu sana hapa kuna matata utatue.

  18. Possible solution to this…
    Possible solution to this issue is going back to our African way. A jury system where we had a panel of elders listening and deciding the cases . This will require translating cases to local languages so all can participate and making the hearing public so the cases are not decided by individuals. As long as we are following the system that was left behind by Mzungu and continued by our local masters that replaced the Mzungu we are bound to fail big time. No wonder when things go wrong we go to the colonizer for help even though we know historically that the same colonizers used the same law to steal our land, resources, maime and kill our fore fathers and our loved ones. No wonder the colonizers always come to participate in our affairs because they are ahead of the game. They plant the seed and know where we will fall and as soon as we fall, we look for them to save us. While saving us they plant a new seed and the vicious cycle continues. We keep begging for money and they give us conditions that they need to monitor that money and give us advise. So the cycle continues. We are currently dealing with 47 governor’s in a country the size of Texas. How did we get there?. Yester years we had Kibaki with a full cabinet and Raila a full cabinet. We cannot move forward with the colonizers as advisers and us being beggars. It’s time for Wananchi’s to decide their path. Get away from those foreign loans. It’s better to take one slow and sure step than ten steps and fall back fifteen . No wonder the colonizers are always in our country doing research studies to to keep us in check. We have more than 1000 NGO’s in Kenya. Doing what? How can we move forward if we have involved the colonizers in every aspect of our lives to make decisions. Our constitution, our language’s, our names, our God, our health, our food, clothing , finances, infrastructure, education (we keep changing our education system from this to that because we have nothing to call our own) It’s only Kenyans of good will and those who love our country who can stop this madness and give our country a new path. It is not going to be easy, but it can be done and it will be done because there is no other way. The leaders we have had since independence
    are compromised and can never take Kenya anywhere. Kenyans with money love your country
    and invest in your people, in your cultures. Do not lie to yourselves that you will invest happily outside your country. Black man is hated around the world by every other race. Black man needs to invest in his names, language,culture and his God. Black man need to seriously invest in himself. Those who tell you to invest outside your country are the same ones who carried your forefathers as slaves and enslaved others in your own country. Invest in your own people. Before investing outside of your country, find out the black man’s position in that country. Know they station. God give Kenya leaders not politicians! God help Kenya!!!
