Embakasi East Member of Parliament Babu Owino is set to move to the Appellate Court to appeal Friday High Court ruling that nullified his election.
In his ruling, High Court Justice Joseph Sergon said that Owino’s election was marred by violence and systemic irregularities.
He further ruled that the petitioner, Francis Mureithi of Jubilee Party, tabled sufficient evidence to prove that the entire process was marred by violence, intimidation and other malpractices.
“Considering all the evidence tendered before me, I find that elections in Embakasi East were not free and fair as the entire process was dotted with violence occasioned by the voters and supporters of Mr Owino,” Justice Sergon ruled.
Consequently, Owino was ordered pay Mureithi and Independent Electoral and Boundaries Commission (IEBC) Sh2.5 million each.
However, speaking after the ruling, the former University of Nairobi student leader said he would appeal the judgement, even if he is sure of a victory in case of a by-election.
“I would like to state clearly that the whole nation knows what happened. The whole nation knows that this is a war between Babu Owino and President Uhuru Kenyatta and Deputy President William Ruto.”
He added: “The whole nation knows that I have been highly critical of the president and his deputy. It is sad that the Executive is using its influence to arm-twist the Judiciary. What can’t kill you, can only make you stronger. If Uhuru and Ruto decide to come and vie in Embakasi East, I will beat them yesterday in the morning,” said Owino.
Owino’s lawyer Edwin Sifuna says his team will file an appeal to the ruling as soon as possible.
“We respect the decision of the court, but we truly disagree with the judge’s conclusion. We absolutely have no doubt that our client won the election fairly and squarely, given a vote recount was ordered and he still emerged the winner.”
” We’ll file an appeal against Justice Sergon’s ruling. As we speak, Mr. Jackson Awele is filing an appeal against the judge’s decision to annul Mr. Owino’s election,” said Sifuna.

That’s the only option you have, where you are likely to lose. Save your money to pay for court cost and rerun.
Babu, why do you feel so…
Babu, why do you feel so important. If Uhuruto were to have time for witch hunting any politician, you are too low in the ladder.

Babu hana heshima. Never learns nor remorseful. Still hurling abuse at the president after he was nullified: https://www.youtube.com/watch?v=8V-L-PWOGjo. I dread to think how the conversations in schools shapes up, what with the examples set by these filthy leaders!

@Sukari:
The political system that we have adopted in Kenya was borrowed from our European brothers and sisters. Please see below how it works in the USA in terms of ” …freedom of speech…” The president is just an ordinary citizen who is not above the law.

Ongili is potraying a bad image by dragging Uhuruto in his predicaments. Uhuruto do not control the judicialy and if they ever did the 8/8/2017 elections would not have been anulled coz they were victims.
Babu is popular for the wrong reason and the cure is round the corner. Ati he can beat uhuruto if they vied in Embakasi East!! Shame Babu, statistics have it that Jubilee presidential candidate had almost double what u got. Siasa duniiiiii!!!
@Imara, just because we were…
@Imara, just because we were colonized by the West does not mean we adopt their every flaw or perfection, as one may see it. We have our cultural values which we have faithfully relied on as a moral compass, and so far has never failed me. Living in Europe, I see difference in leaders but they take the battle to the ballot boxes. This new way of abusing shamelessly especially from Kenya is new to me. These figures are meant to be an example and moral models to their constituents.. Uzima is being able battle out your differences without stooping so low. I am concerned about the young in our country and dread to think how the fights in the playground may look like…. in the clip I sent, one can clearly hear a woman abusing “Mku%%! nyeusi”. Who says that in a crowded place, alafu it is a woman to top it all?!! We are fast stepping into the labels slapped on us by the West, i.e “sh$%holes”. Kenya is in crisis and if I am honest, I despair for it’s future.
