12 National Super Alliance (Nasa) leaders have obtained anticipatory bails from the High Court barring Director of Public Prosecution (DPP) and the police from arresting and prosecuting them for being actively involved in the swearing-in of Raila Odinga.
On Tuesday, the 12 filed an urgent application at the Milimani law court seeking the bails, arguing that they feared being arrested and detained just like former Nairobi gubernatorial aspirant Miguna Miguna.
They include; Siaya Senator James Orengo, Makadara MP George Aladwa, Dagoretti North’s Simba Arati, Vihiga senator George Khaniri, Businessman Jimmy Wanjingi, Nasa CEO Norman Magaya, and Homa Bay Women Rep. Gladys Wanga.
Others are strategist David Ndii, Embakasi East MP Babu Owino, and Oduor Ong’wen, Kakamega senator Cleophas Malala, and Governor Hassan Joho.
The Sh100,000 bail for each was granted by High Court Justice Luka Kimaru, who further ordered them to appear before the DCI on Thursday at 11am for further directions.
Through lawyer Nelson Havi, the 12 told the court that they are ready to avail themselves to a just and fair legal system.
“Our apprehension is that the primary motive is to oppress and even fatally harm, injure or kill us,” they argued in their application.
However, in a statement after the court granted the anticipatory bail, National Police Service said it had no intention of arresting any of the twelve leaders.
“The National Police Service wishes to state that neither Hassan Joho, Jimmy Wanjigi, David Ndii nor the 9 others who have sought anticipatory bail are being sought as of now in connection with commision of any crimes.”
“Those individuals should therefore not bother turning up at the DCI offices. They are not persons of interest to the Police as of now.”

The executive branch of government through its police and other law enforcement agencies is supposed to enforce the laws of our country. So, either these Odinga Demonic Morons broke the law and, therefore, must be arrested and charged accordingly; or else if they didn’t break any laws they shouldn’t be afraid of police arresting them. As such, for this highly compromised judge to issue anticipatory bails rather than to let the law take its course is not only premature but is also hpocritical in that on one hand he can’t complain of government not obeying court order while on the other he is inhibiting the executive from implementing its mandate to enforce law and safeguard security in our country. ONLY in Kenya where judges act like they are above the law and above the other two arms of the government. If judiciary wants the executive branch to respect court orders, then it too must act within the law — let executive carry its mandate without undue interverance by the judiciary. Judges must wait for cases to be brought to them — not to preempt arrests or block the work of law enforcement. It seems like a majority of judges are paid protection money to protect unruly opposition even when they commit treason in glaring daylight.
