Jubilee MPs to Amend Law Next Week to 'Cage' the Supreme Court

A fresh showdown between Jubilee and NASA MPs is expected next week in Parliament as the ruling party prepares to introduce radical electoral amendments to curtail the powers of the judiciary and “cage” the Supreme Court.

President Uhuru’s party saud it will amend the law to make it almost impossible for the apex court to overturn a presidential election.

Sources within the ruling party saud that the amendments would be introduced to Parliament on Tuesday next week and swiftly enacted by the JP majority.

On Wednesday, the Supreme Court said it would not delay to invalidate the outcome of the rerun if it similarly violated the Constitution and other laws, like the August 8th poll.

Senate Majority Leader Kipchumba Murkomen said when the amendments go through, “The Supreme Court will be caged.”

Among the radical and far-reaching amendments that President Uhuru’s side has lined up, is a proposal making it almost impossible to overturn a disputed presidential election.

Jubilee wants to raise the bar of invalidating an election by making sure that the petitioner, must beyond any doubts, prove to the Supreme Court that violations of the Constitution or any electoral law significantly alter the presidential outcome, as declared by the IEBC.

In her dissenting ruling, Justice Njoki Ndung’u asked Parliament to clarify an clause of the elections act.

“Parliament must therefore untie the hands of Courts below by clarifying the meaning of Section 83 of the Elections Act. That is the only way that we can avert a crisis of jurisprudence in such a sensitive area of law, as elections”, Njoki wrote.

Murkomen told Citizen TV on Thursday, “Once we do that [pass amendments], the Supreme Court has no choice. They cannot go pluck imaginations of their own. They would have to follow the law.”

    Let me state the obvious by saying that.All state institutions that is the IEBC,the Supreme Court and others MUST ensure that the will of the People is respected.We have to have strict fidelity to the clear will of the People in Kenya.Votes have to be accurately counted. The supreme court judges have to accurately affirm the clear will of the People.This is the only way that we can ensure that we advance the course of Peace, Civil Order and Stability in the country.We all need PEACE regardless of whether we are in NASA or in JUBILEE.That is why it is a MUST that the votes be accurately counted and affirmed.If the state institutions don’t do this,then they would inadvertently and foolishly lead the country closer and closer to a chaotic destination.Nobody needs chaos in Kenya regardless of whether they are in NASA or in Jubilee. The ordinary mwananchi needs to move on into activities of Peace Building, Nation Building and Development.Let us all stop allowing this opposition demagogue to mislead the country into uncertainty and instability.Let us call a spade a spade.The majority of Kenyans want to elect UHURU as President.Therefore, let IEBC do a good job at counting these votes.Let the supreme court Judges affirm the majority will of the People.Let the losers accept defeat.Let the country move on in PEACE and STABILITY.Simple.Elections come and go.There will always be another election at an appropriate constitutional time for political candidates to compete in.

    At the moment I see that the current members of the Jubilee alliance are beginning to take us back to the days (Ndugu Toroitich) when the judiciary was an extension of the executive branch of the government. The chief justice took orders from the president. This led to the second liberation of Kenya when many Kenyans were jailed, killed, held in detention and others tortured in Nyayo House.

    Matiba and many more others sacrificed during the second liberation and are now witnessing a gradual return to the “Nyayo Days” philosophy. Those were very challenging days because they demanded total obedience and sycophancy to President Toroitich Arap Moi without doubting or questioning anything that he did.

    We have to learn from our past mistakes and move forward. But before we do that, we have to stop and think again about all our heroes of the second liberation. Had they not made sacrifices and faced the wrath of Ndugu Toroitich, we could have been mentally dead and living in constant fear like the current citizens of North Korea, Saudi Arabia, Rwanda, Russia, Uganda, and Zimbabwe. No leader is indispensable! Leadership should not run in families including their immediate relatives. We are (unfortunately) moving in this direction. Rumor has, Ndugu Gideon Moi is being groomed to take over after Uhuru in 2022! Let us not create a monarchy in Kenya!

    For all the people who hate Raila, I would like to remind them that, Raila is not responsible for the deaths of Chris Msando, Jacob Juma, Robert Ouko, Josiah Mwangi Kariuki, Ronald Ngala, Arwings Kodhek, Tom Mboya, Pio Gama Pinto, and the deaths following the election of 1992 and 1997 and deaths in Kibera, Eldoret, Limuru, Naivasha, Nakuru following the election of 2007! The emotions (amygdala) are now running high in our country. Let us give a chance to the part of our brains that deals with logic – cerebral cortex to take over salient issues to do with the future of our nation.

    Let us also take another moment to reflect the current elected members of the Jubilee alliance in our parliament. Except for Dr. Kiraitu Murungi, none of them participated in the second liberation of Kenya. I beg you to be calm, compose your thoughts before you verbalize them. We don’t want to live in fear again as those challenging days of President Jomo Kenyatta and Toroitich Arap Moi! Thank you Mwai Kibaki FOR NOT CREATING an environment where fear, total obedience and sycophancy was the order of the day during your term in office as the former president of Kenya.
