MP Aden Duale Seeks to Ban Pornography in Kenya in Proposed Bill

Garissa Township MP Aden Duale has crafted a Bill that seeks to criminalize pornography in Kenya.

The Bill, which seeks to amend the Computer Misuse and Cybercrimes Act of 2018, wants the sharing of pornographic materials on the internet banned. It also seeks to have websites that host pornographic content blocked in the country. 

The proposed law imposes a fine of Sh20 million or 20 years in jail for those found guilty of sharing pornographic materials.

“A person shall not knowingly publish pornography through a computer system produced pornography for its publication through a computer system, download, distribute, circulate cell, or make it available in any way for telecommunications operators,” the bill reads in part.

Last year, Education Cabinet Secretary Prof. George Magoha vowed to push for the ban of all pornographic sites in Kenya, saying they were to blame for the high rate of teenage pregnancies in the country.

He said he would petition President Kenyatta and the Cabinet to introduce a law blocking all Kenyans from accessing pornography on the internet.

“You see when you are not thinking about sex but someone opens a pornographic page then you start thinking about it and generating ideas. Why is that site accessible in Kenya? Who needs it?” posed Magoha.

“Don’t tell us because it is accessible in the US that it should be accessible here. There many countries in Africa and Asia that have blocked it and their culture is better.”

Kenya Film Classification Board (KFCB) CEO Ezekiel Mutua has also been calling for the ban of pornography.

    I doubt the assertion that pornography is to blame for the high rate of teenage pregnancies. From personal experience, i grew up in a rural area back in the days when there were no computers or even cell phones, and teen girls were still getting pregnant. Banning porn will not resolve this issue. if we want teen pregnancies’ to reduce, we should start talking to teens about responsible sex, something that was done very well in traditional African societies (by aunts, during rites of passage, etc). But these traditions are no longer seen as relevant or necessary, but they were very effective in teaching young people about sex and life in general.

    I am not sure if there is a correlation between teenage pregnancy and pornography.I think alot of factors put together contribute to not only juvenile offending and moral decadence..The list includes the follows: drinking alcohol,lack of good adult role models, laxed parental discipline,too much western cultural influence,lack of sex education,and pressure from men.
    You take out pornography,and leave the aforementioned vices,and you will still have high teenage pregnancies.
    To me, the question is, why is pornography in Kenya,if not to satisfy some demand.You ban it, it goes underground.Besides that how are you going to do away with what “consumers” already have?
    As much as pornography is vilified, there are some vices with equal measure,if not more.Prostitution, school girls looking for sponsors,men and women having mipango ya kando, marrying multiple women under the guise of african culture,girls being sold to wazungus for sex tourism, child marriage,genital mutilation, on and on.All these evils pale in comparison to “damage” done by watching naked women. We fix them,and pornography will not be an issue. My two cents.

Porn my idiot friend is simply an education tool to teach us new and weird positions to please ur mate and u would be much happier if u watched alittle n shock ur wife with new bedroom action, then u can focus on more important issues like the high rate of poverty in Garissa. You were elected to serve the people n do not see how banning porn would fix the problems facing the nation. Ngombe wewe.

      @Shaka, talking of corruption, a Kenyan athlete,Nelly Jepkosgei has been banned for avoiding dope testing,by claiming that her sister was in aserious accident,and that’s why she missed the dope test.Unfortunately,the medical documents she produced were fake.In admission to the violation,her ban was reduced to 3 years.She was in the process of changing her citizenship to one of the oil rich countries. I wonder if they paid for the faking.
      Olympics will soon be here.I hope Athletic Kenya will make sure no dopers are allowed to represent the country.Remember RIO olympics training Kits mysteriously disappeared.If we care about our county’s reputation,this are the vices we should fight against.The world will just laugh at us if we ban porn,and allow doping,corruption,and human trafficking to thrive.

    Which culture are these guys talking about?Corruption including adultery,bribery,looting,idol worship etc from president to ordinary makanga & KOINANGE traders are the only cultures most Kenyans believe in.Maybe Mogoha,Mutua and thug Duale are sons of “ bishop” Deya.If not the three are products of sweetness/utamu/murio enjoyed by their parents’ intercourses.

    Liberal culture with no bounds responsible for porn vice. Outlawing it is a great step forward. Just block it from safaricom and airtel. Other steps such as going back to conservative culture and fear of God will eliminate the rest.

      Besides that should we give in? Why not teach people self control?That way it would help them in various disciplines.
