Swearing-in of New Nyeri Governor Postponed Indefinitely

The Swearing-in of Nyeri Deputy Governor Mutahi Kahiga as the new Governor of Nyeri County has been postponed indefinitely.

Kahiga was set to take Oath of Office on Thursday after the death of his boss Dr. Wahome Gakuru, who perished following a grisly road crash along Thika-Kenol highway at Kabati area on Tuesday.

Nyeri County Minister for Infrastructure and Communication Muthui Kariuki said the postponement came after an advice from Council of Governors led by Chairman Josphat Nanok.

In a press briefing on Tuesday at Serena hotel, Governors had raised concerns over the immediate swearing-in of deputy governors upon the death of governors.

Article 182 of the Constitution states that, when the office of the County Governor becomes vacant due to among other reasons; death, the deputy governor assumes office for the remainder of the term.

Dr Gakuru became the second Nyeri Governor to die while in office after late Governor Nderitu Gachagua, who died in February, 2017 while undergoing cancer treatment at the Royal Marsden Hospital in London, United Kingdom.

The then Nyeri County Deputy Governor Samuel Wamathai was sworn-in two days after Gachagua’s death for the remainder of the term running to August 8th election.

Wahome Gakuru will be laid to rest on Saturday, November 18 at his home in Nyeri.

    So what Law prohibits the swearing in of the Deputy governor in to the high office of the central republic of kenya. Seems like a power vacuum issue.

    Article 182 of our constitution is clear and deputy governor Kahiga should be sworn in pronto. This abuse of our constitution and the laws of the land by those with mandate to protect and defend the constitution is the greatest stumbling block in the implementation of democracy in Kenya and Africa. Just remember that the constitution cannot stand up and assert itself- it requires discipline,commitment and consistency by all the citizens. Unless deputy governor Kahiga is directly or indirectly the cause of Wahomes death, blocking his swearing in as Nyeri governor is unconstitutional and a great shame for those trying to subvert our constitution. We either follow our constitution and our laws or abandon them all together and become a banana republic but we cannot have it both ways.

      Mwororo seems not to know that the so-called governors take counties to be their private property.All the same Kenyans need to amend their expensive constitution to merge these excessive counties to five manageable ones.I remember Kibaki telling Kenyans in Gitaru,Kiambu in 2009 that Kenya will be the Africa’s US(50 states) if they pass the constitution but he never told the senseless villagers where the resources were to finance the bloated govt.

    i thought the governor have to be sworn in immediately until new byelection within 60 days are held if the deceased governor has not been in service for 2and 1/2 years or is the explanation wrong this was quotedin one of the newspapers referring to the constitution

    Since governor Gakuru had’nt dedicated any official duties. Nyeri people deserves a new elected governor.swearing in his deputy as new governor is fraud.
