Suba South Member of Parliament (MP) John Mbadi is seeking to participate in a case filed by the Law Society of Kenya challenging the deployment of military officers.

The case, brought forth by the Law Society of Kenya, centres on the deployment of military officers within the country and raises questions about its constitutionality and adherence to legal procedures. Mbadi, along with Dr James Nyikal and Wilberforce Ojiambo, contends that their participation is essential, claiming to possess crucial information about the approval process and its alignment with constitutional provisions. Mbadi’s position is bolstered by his extensive experience, having served as the area MP for three consecutive terms, spanning 15 years.

His legal team aim to address whether the deployment complied with the Constitution and if the approval process adhered to constitutional guidelines. However, the Attorney General opposes their inclusion in the case, citing unmet criteria. Principal State Counsel Emmanuel Bitta emphasizes that interested parties must formally apply, specify their intended arguments, and demonstrate the specific prejudice they would suffer if not allowed to participate. The court is expected to weigh these arguments before issuing a ruling.

Mbadi is seeking to return to parliament to represent his constituency. His political rival, Suba South MP Caroli Omondi, has been critical of Mbadi’s previous tenure, highlighting his own achievements during a shorter period in office. This dynamic adds another layer of complexity to the legal battle, as both politicians vie for the same political seat in the upcoming 2027 election.
