Joseph Irungu, known as Jowie, has formally declared his intention to appeal against his recent conviction and the subsequent death sentence issued against him.

Jowie, represented by his lawyer Andrew Muge, has clarified his intent to challenge both the verdict and the severity of the penalty. In his notice of appeal, Jowie states, “Take notice that Joseph Kuria Irungu alias Jowie appeals to the Court of Appeal against the decisions of the Honourable Lady Justice Grace Nzioka delivered in open court at Milimani, Nairobi on the 9th day February 2024 and in her written judgment dated 9th February 2024 whereby the Appellant was convicted of murder and sentenced to death on 13th March 2024,”

Justice Nzioka justified the imposition of the death penalty by citing Jowie’s perceived lack of remorse for his victim, Monica Kimani, who tragically lost her life on September 19, 2018, in her apartment. The judge ordered that Jowie would face the death penalty as prescribed by section 204 of the penal code of Kenya unless a higher court intervenes and overturns the sentence. Irungu has expressed his intention to attend the appeal hearing as indicated in his statement. During court proceedings, the probation officer Mr Andrew Kanyotu presented a report detailing Irungu’s behavioural tendencies. The report described him as someone who struggles to maintain stable relationships and exhibits anti-social behaviour by living on the edge.

Additionally, it noted Irungu’s impulsivity and inclination towards seeking thrills, often resorting to anger or aggression to manipulate others. The report also highlighted Irungu’s dual personality trait. Justice Nzioka emphasized that the sentence imposed on Irungu should serve as a deterrent not only to him but also to society, given the increasing number of killings, particularly of women. The judge further remarked on the brutality of the crime, involving the slitting of Monica Kimani’s throat and leaving her lifeless body in a bathtub with water running.

According to the judge, the execution of the crime pointed to the involvement of a skilled individual rather than an amateur, indicating a lack of intent to allow the victim even a moment of survival.
