German National Charged With Defiling a 15-Year-Old Girl in Kilifi

A 32-year-old German national Mr Netband Tim Marvin, finds himself entangled in a legal saga following allegations of defiling a 15-year-old Rwandese girl in Kilifi county.

The German businessman was apprehended on Saturday and brought before Kilifi Senior Resident Magistrate Daniel Sitati on Monday. The accused vehemently refuted the charges levelled against him but is currently remanded in police custody for a week pending a ruling on his bail plea. The prosecution alleges that Marvin committed the offence at his residence in the Mtondia area of Kilifi North Constituency. Having moved from Nairobi to Kilifi just four months ago, the victim bravely confided in her mother about the incident, which prompted the intervention of law enforcement authorities.

Prosecutor Nancy Njeru expresses concerns over the flight risk posed by the accused, citing the possibility of absconding or witness tampering. Njeru also hints at the prosecution’s intention to amend the charge sheet to include an additional charge of child pornography. Marvin’s defence counsel Patrick Ndaime counters the prosecution’s stance, arguing for his client’s right to bail. Ndaime highlights Marvin’s willingness to surrender his passport, lack of property for bond collateral, and cooperation with law enforcement as factors in favour of bail consideration.

In response to the prosecution’s allegations of child pornography, the defence emphasizes Marvin’s readiness to comply with any court directives and his residence and business ties to the area. Magistrate Sitati has ordered a bond report from the Office of Probation and Aftercare Services within seven days to assess Marvin’s residential status. The court underscores the gravity of the offence, the accused’s ties to the community, and the potential for witness interference as crucial factors in determining bail eligibility.

In a bid to solidify Marvin’s ties to the locality, the defence has presented a lease agreement between Marvin and his landlord, indicating a six-month tenancy arrangement valued at Sh250,000. The case is scheduled for mention on February 20, awaiting further legal proceedings.
