A Kenyan woman is embroiled in a fight for a Sh12 million matrimonial home in Malindi, Kilifi County with her estranged Danish husband.
Vivien Nasimiyu Wamalwa sued her estranged husband Wesche Simon Enna, accusing him of blocking her from accessing the property after their breakup.
While the woman accuses Simon of taking advantage to lock her from accessing the home when she was away after the breakup, the foreigner claims it was his estranged wife who took advantage when he flew out of the country to take possession of the property.
Senior Principal Magistrate J Ong’ondo issued orders stopping Simon from limiting the woman’s access to the property until her case is heard and determined.
“The respondent, Wesche Simon Enna, his agents or any person acting on his behalf are hereby restrained from evicting her or interfering with her access to the matrimonial home known as Harbour Cottage pending determination of the dispute,” ruled Ong’ondo.
The magistrate further barred the respondent from selling or disposing of the matrimonial home or altering names of beneficiaries until the suit is determined.
Through her lawyer, Nasimiyu told the court that they jointly own the property but after they separated briefly due to domestic fights, the man changed all the locks and instructed a security guard not to allow her in.
“He excluded his wife from using and accessing their matrimonial home despite having equally contributed to the purchase of the property,” lawyer John Swaka submitted.
In response, Simon accused Nasimiyu of tricking him to include her name in the sale agreement when she did not contribute anything towards buying the home.
The Danish national said he singlehandedly paid Sh10.5 million purchase price and spent an additional Sh2 million on renovation after selling some of his properties in Denmark.

If couples really marry for…
If couples really marry for love, then why is it that when they divorce, the fight is for property? Why not fight for the lost love,so that you gain it back? Yes, its all about trade- offs.
The more I read such fights on who should get what..etc, the more I agree with @ Formerly GUest2,” there is nothing like love in marriage”. Iam paraphrasing here…
Polls in Kenya have revealed that agood number of men are not including their spouses in their investments.I wonder why?
Wamalwa claims that the property is jointly owned. That could be true. However note that, that statement is not the same as saying ,”we contributed equally in the purchase of this property”.If you apportion “ownership” base on who contributed more,,that if it could be proven, them sell the damn house and prorate the proceeds. Right?

Why would a sane man travel all the way to Kenya in search of a rotten p**sy!!, while kuma is free in Denmark!!?? Simon, you should have left your money in a Danish Bank. Kenyan women surely love the value of the foreign currency and they don’t hesitate to use Kuma to earn it through unfair means. Who does not like a free good life??

Good question @ Mark.Surely why would some man leave women he is familiar with ,in his community, and travel miles for some woman in a culture, and customs he has no idea about…?Unless local women in his community are horrible…
Wazungu, especially old men have been conditioned to think that women from third world countries, expecially africans are submissive, respectful, and loving. All you have to do is rescue them from povery and they shall forever worship you.Obviously when the Danish goes back,he will enlighten his country men.
