Azimio presidential candidate Raila Odinga says the postponement of elections in eight areas was a deliberate voter suppression scheme.
While making her submissions in the Supreme Court on Wednesday, lawyer Julie Soweto argued that elections were canceled only in Raila’s strongholds and this greatly affected the voter turnout.
She referred to the affidavits filed by Celestine Anyango, Arnold Oginga and Raila’s agent Ezra Singuti.
The lawyer submitted that the 1st petitioner (Raila Odinga and Martha Karua) did not start equally as the 1st respondent (William Ruto and Rigathi Gachagua).
“When elections started, [Raila] did not start equally with the [Ruto],” said Soweto, who is representing Odinga.
Soweto further questioned why the Kenya Integrated Election Management System (KIEMS) kits only failed in Raila’s strongholds.
Raila’s agent Ezra Singuti says in the polling station he was manning, polling started as late as 1.00 pm due to KIEMS kit failure. Soweto told the court that where polling started late the time was not extended for voters to cast their votes.
“It cannot be coincidental that only faulty KIEMS kits were sent to [Raila’s] strongholds. Ezra Sunguti also testifies in his affidavit that polling started at 2pm and was not extended beyond 6 pm despite starting six hours later than when the polls were supposed to open,” she told the court.
Soweto concluded her submission by alleging that the postponement of elections in the eight elective posts, including Kakamega and Mombasa counties, was deliberate and not accidental.
“The cancellation of the votes in that particular areas suppressed the voter turnout. And this can be seen by looking at the voter turnout in those constituencies as compared to voter turnout in neighboring constituencies or counties. We find that there is a vote differential of about 5% or 4% when you compare that turnout of areas election was canceled and areas where vote was not canceled,” she said.
