Raila Files a Petition at the Supreme Court Challenging Ruto's Victory

Azimio La Umoja-One Kenya coalition presidential candidate Raila Odinga has formally filed a petition challenging the results of the August 9th presidential election where UDA’s William Ruto was declared the winner.

The petition was filed on Monday morning at the Supreme Court’s sub-registry located at Milimani law courts in Nairobi.

Odinga, his running mate Martha Karua and other Azimio leaders arrived at the registry in the company of their legal team to deliver physical documents for the petition challenging Ruto’s victory. 

The coalition has maintained that it has sufficient evidence in the petition to prove misconduct by the Independent Electoral and Boundaries Commission (IEBC) and the election was rigged in favor of Ruto.

“We have a strong petition and we’re hopeful that it will go through. We’re asking the court to decide if the constitution was followed in declaring the presidential results. If it was not within the constitution, then it is null and void,” one of Odinga’s attorneys Daniel Maanzo told CNN on Monday.

IEBC Chairman Wafula Chebukati declared Ruto the winner of the contest after garnering 7,176,141, representing 50.49 percent of the total votes.

Odinga came in second with 6,942,930 votes (48.85 percent), followed by Roots Party candidate George Wajackoyah (61,969 votes) and David Mwaure (31,987 votes).

The Supreme Court has 14 days from Monday to hear the petition and deliver a verdict. Should the seven judges rule in favor of Odinga, they could order a recount of votes, a fresh election, or award him the presidency.

    Returning officers, IEBC commissioners who assist in altering counted votes belong in jail.

    Chebukati and all the returning officers who altered the vote course belong in jail.

    The elections in those locations need to be repeated.

    Those areas where the votes do not add up need to be overturned , those returning officers need to be charged in the court of law and the elections need to be repeated.

    Raila tried to pull a 2007 and people said no. Ok. He wins the petition what will happen? Kenya will be know to host failed elections since inception?
    Reasons supreme court will not nullify Ruto’s election as president.
    1. They are not ready to create constitutional crisis as IEBC will then be severly compromised to be able to do any reelection and Uhuru being caretaker president means he cannot appoint new IEBC commissioners.
    2. The same people who will be asking court to nullify elections refused to participate in the elections in 2017 after the courts ordered a repeat election. The courts won’t be ready to create for them such scenario again which almost proved destabilizing in 2017.
    3. The courts in 2017 asked IEBC to open servers. In this elections they did by transmitting and posting all results from all the polling stations on a public portal enhancing transparency, credibility and avoiding interference of results.
    4. The people petitioning courts to nullify elections because of claims of rigging had all manner of state support in the elections and use govt resources to do campaigns. The court will find it difficult to side with them and believe that the elections was rigged.
    5. The courts will find it difficult to nullify two elections in a succession because it then makes kenyan elections to be always legally challenged and settled in courts instead of the ballot as it should be.
    6. Most of the local and international independent observers agreed that the elections were free and fair and agreed with the tallies that were announced by the IEBC hence giving a thumbs up to the elections.
    7. The results from polling stations contained in form 34A are final and are all posted in public portal. So far so good no one has provided any evidence to the contrary to show that the results in form 34As do not reflect the results as announced in the polling stations.
    8. Its easier for courts to uphold the elections because it maintains political stability judging by the public mood and avoid throwing the country into an electioneering and constitutional crisis. Thus they will go for an easier option.

    In Kenya Pharaoh is doing the same. The God of Kenya is about to sort out this mess.
    This is spiritual might ( the will of the people) verses physical might ( Money, Corruption, bribery ).
    Just like last time in court, it will be on full display for the world to see. It might put to an end Kenya’s constitution and democracy and help to put in place God’s law and order.
    In Kenya the labor pains are real and a new baby is about to be born.

    The scenario here is very simple, Raila and Uhuru will try and influence the supreme court for a recount, which they will manipulate and declare Raila the president or just declare him president outright. They can’t afford a rerun because they understand that the masses will again vote for Ruto.
    This will turn out to be a soap opera.
    How do you end up having a truck load of evidence? This will be purely drama.
    But,these are the last kicks of a dying horse.
