Kapseret MP Oscar Sudi has been acquitted in a case in which he was accused of insulting former First Lady Mama Ngina Kenyatta, the mother of President Uhuru.
Sudi was in September last year charged with two counts of hate speech and offensive conduct over alleged insulting remarks directed at Mama Ngina.
While acquitting the MP on Friday, Nakuru Principal Magistrate Isaac Orenge said the prosecution did not provide sufficient evidence to warrant a conviction.
“The prosecution evidence that the offensive words were uttered at an unknown place and he said was likely to occasion a breach of peace. I have considered the evidence of all the witnesses there was no witnesses who stated what effect the words uttered had on them,” the magistrate ruled.
He added: “In a matter where it is alleged that the act was intended to provoke a breach of peace, the prosecution is duty-bound to prove beyond reasonable doubt that the act complained of was likely to make people resort to physical violence.”
The court also faulted the prosecution for failing to demonstrate how the accused’s remarks as captured in the clip stirred up ethnic hatred.

Such prosecutors should be fired! A real prosecutor cannot accept to take up such a case. Waste of public resources and unnecessarily jamming up courts. Surely how can calling Ngina names be construed to tricker tribal hatred or violence?

Do I to say incompetence? As a persecutor, you have to weigh your case in relation to the laid laws. Prosecutors have a wide discretion of tossing out such cases as those that does not meet the charge. Directions “ from above” is a detriment to justice.

I think you are so used to…
I think you are so used to mean people or environment who only takes away from you such that you really get mesmerized when you see the haves’ who are willing to share. About 95% of Kenya’s people representatives are corrupt. Among this percentage you can only find some 5% who are willing to share the loot! Who amongst deserves to be cited here?;- the mean looter or the generous one? This is not to say Sudi stole or looted anything. He runs some businesses as I understand. It could be his honest way of giving back to society.
