Nairobi businessman Tom Oywa Mboya was on Wednesday sentenced to 23 years in prison.
Mboya was handed the sentence by Chief Magistrate Martha Mutuku of Milimani law courts after he was found guilty of attempted murder.
The tour operator was accused of shooting Ranalo Foods Restaurant owner William Osewe multiple times in 2016.
The court heard that Mboya shot Osewe in December 2016 at Garden Estate in Kasarani, Nairobi following an argument over a woman identified as Stella Mutheu, who is believed to be Osewe’s wife.
The court also convicted him of unlawfully wounding Wilfred Tembula, who was injured during the shooting incident.
Following the shooting, Osewe was admitted at Aga Khan Hospital’s High Dependency Unit (HDU), where he underwent surgeries to remove the bullets.
Mboya surrendered himself to Kasarani police station and was arraigned in court where he denied charges of attempted murder. He was released on a cash bail of Sh300,000 pending the hearing and determination of the case.

As I always say, if you love yourself, make decisions that will not put your life at risk.Affairs dont just happen.People make decisions to have them despite the inherent risks…Women have their own reasons for having affairs,apart from lies and charm from men.But men tend to use the small brainless head,which is obviously impossible to think with.I guess they dont think.

How did you arrive at the idea that the sentence is fair? I personally think that,if you shoot someone and he survives as in this case,no self defense you get half of alife sentence. That is if the life expectancy in Kenya is 66, you get 33 years in prison.That’s how I arrive at my sentence. Not sure how the law came up with 23 for this guy any idea?Anybody?

I based on the fact that several politicians have committed similar crimes and are still roaming around! Look at Babu, obado, DP Ruto, judge who was seducing Cohen’s wife, etc! We really hear when the law will be applied on them to pay fir the crimes they have committed!

@ Willy, obviously the fault is not in the law,but in its application. If Obado kills and walks,its not the fault of the law,but how,and who applied it.A law cannnot have 20 interpretations.First degree murder with similar extenuating circumstances gets same punishment.What say you?

The judgement is fair considering others have walked Scott free like Zimmerman and others got light sentences like Amber Guyger. A lot of factors can go into determining his sentence. He turned himself in and didn’t run, the shooting occurred after an argument with the victim (could have been fear, rage etc), he has no prior criminal history.
The guy will be in his 70s when he is released.

Irrelevant in this day and age. 60% of the people on this earth are not circumsized and are not as ignorant as you. Removing a piece of foreskin whether at the river or in a clinic setting does not make you superior than anyone else. It is just a tradition – mostly likely borrowed from Jewish culture.

Muuaji Mboya deserves a more deterrent sentence than 23 years.He should have been shot five times first.But Noordin should clarify whether Mboya was tried/convicted for shooting Osewe,Raila’s former PA.He should also explain why Babu Owino,a Raila KICHEN CABINET KASHIA cannot be tried for a similar offense.
