Haji Defends Decision Not to Charge Judge Sankale Ole Kantai with Tob Cohen's Murder

Director of Public Prosecutions (DPP) Noordin Haji has dismissed claims that he refused to charge key suspects in the murder of Dutch tycoon Tob Cohen.

Haji stated that there was no sufficient evidence to prefer charges against Appeals Court judge Sankale Ole Kantai, who has been fingered in the murder of Cohen. 

“In respect of investigations into the involvement of Honourable Justice Sankale Ole Kantai, upon a thorough perusal of the inquiry file and analysis of the evidence, the ODPP was satisfied that there was no sufficient evidence at that time to prefer charges against the said suspect unless additional evidence was made available to warrant a review of the said decision. This decision was communicated to the DCI,” Haji said in a statement on Tuesday.

Haji noted that he was satisfied that there was enough evidence to charge Cohen’s widow Sarah Wairimu Kamotho and her co-accused Peter Njoroge Karanja.

The DPP further clarified that he was ready to review his earlier decision should additional incriminating evidence against any suspect be gathered and made available.

Haji’s statement comes following an affidavit by DCI officer John Gachomo, who detailed Justice Sankale’s alleged involvement in the murder of Cohen.

Gachomo, a senior assistant Inspector General of Police based at DCI headquarters, claims the judge actively participated in the planning and cover-up of Cohen’s killing.

He says that Justice Sankale held several meetings with Cohen’s widow at different places, locations, and dates to plan his murder.

The DCI accusing agents and officers at the office of the DPP of attempting to illegally terminate the investigation to ensure the judge does not face charges.
