Retired Chief Justice David Maraga now says that President Kenyatta should be impeached for violating his constitutional duty.
Maraga, who spoke during an interview with Citizen TV on Thursday, said the president refused to obey three court orders directing him to appoint 41 judges recommended to him by the Judicial Service Commission (JSC).
“There are three court orders directing the President and even giving him a time frame and he has not appointed them. As far as I’m concerned, that is a violation of his constitutional duty,” Maraga stated.
“In fact, I should say if he was in other countries, the President would be impeached for that. Because he swore to defend and uphold the Constitution.”
Maraga, who retired this week said this has never happened in Kenya before, adding that MPs should impeach the president to protect the Constitution.
“I believe there is a provision for which Parliament if it wanted to can use to impeach the President so that everybody is held accountable,” noted Maraga.
Kenyatta reportedly rejected the JSC list over integrity questions raised by the National Intelligence Service regarding some of the nominated judges. He was also concerned about the financial implications of hiring more judges.

I hope the CJ takes time to reflect/soul search and realize that his judgment annulling the presidential election was the dumbest/nonsensical as they come. I hope he will learn from the US elections that in the end “you count the votes” . Unless you can demonstrate that “illegalities” affected your total votes and that recounting will make you the winner you have no case! No amount of stories/violence will change the will of the people. Because of his action , the elections of 2017 are still unresolved and the “grievances” are still being used to blackmail Kenyans. Before the 2010 Constitution, judges were appointed directly by the President. With the new Constituction, names are forwarded to him by the JSC, for him to appoint. If he has reservations about their integrity, should he just ignore his conscience, and put his stamp of approval on people he does not think are qualified? It is also an open secret that the list of 41 mainly consists of sitting judges and magistrates who are being promoted. Should judges be issuing ‘Orders’ about their own promotion, and in effect ordering the President to appoint and promote them? For that is what the court orders that Maraga is talking about amount to. Such a scenario can never happen in any other country. Even in developed countries the judges themselves do not control how they are appointed and promoted. In the US, the Supreme Court now has four judges directly appointed by one President. They should travel to Kenya to learn about ‘judicial democracy’, where judges choose who amongst themselves should be appointed and promoted. Uhuru should follow his conscience. If his role is just ceremonial, then the JSC should just go ahead and appoint the 41, as there is nothing stopping them from doing so.
