Impeached Governors Permanently Barred from Holding Public Office, EACC Says

Impeached governors and state officers are permanently barred from holding any public office in the future, Ethics and Anti-Corruption Commission (EACC) has said.

Through a statement on Tuesday, EACC CEO Twalib Mbarak said persons seeking elective positions must meet the integrity threshold under Chapter 6 of the Constitution.

“The commission considers a person is disqualified from holding public office if the person has been dismissed or otherwise removed from office for contravention of Chapter 6 of the Constitution or its enabling legislation, in accordance with Article 75(3) of the Constitution,” the commission stated.

The anti-graft watchdog further noted that a person is disqualified if they are found to have misused or abused a state office or public office.

“For the avoidance of doubt, the finding contemplated in these clauses includes the finding of a court of law and any other competent agency mandated to interpret or apply the Constitution,” the agency added.

Mbarak added that EACC has a constitutional obligation to advise the Independent Electoral and Boundaries Commission (IEBC) on the integrity compliance status of all candidates pursuant to Chapter 6 of the Constitution as well as the Leadership and Integrity Act, 2012.

EACC’s announcement is a blow to former Kiambu Governor Ferdinand Waititu who is seeking to run for the Nairobi gubernatorial seat.

The Office of the Registrar of Political Parties on Monday cleared him to run for the seat as an independent candidate after certifying that he was not a member of any political outfit and his floodlight symbol did not belong to any registered political party.

Waititu was impeached as the Governor for Kiambu in January this year on the grounds of gross violation of the constitution, abuse of office, and crimes under the national law.

    Mubarak sounds as if impeachment is final or the law itself.The two were impeached by their rivals or other gangsters who were following orders from their party owners.There are judicial process on Sonko and Waititu cases.Will Mubarak eat his words if both guys are aquitted by trained or bribed magistrates/judges?

    Even though I agree for corrupt officials not to occupy a public office, I think the electorate should be the one bestowed with the power to reject such people during the polls. Why am saying this is because at some point, the sitting government officials may collude to take out their competitor or critic in this way just to settle a score. The power to choose leadership belongs with the people not a few in the government.

      @Imara Daima with that I agree. Might end up with bad people buying their own way in. Educating the electorate maybe should be part of the electoral process. Or government should realize what makes it’s people sleep hungry. We all believe it’s not by choice.
      This alone cannot be an excuse to have them exercise a democratic right of whom they want to choose as their representative. It should be the government dictating who should NOT contest. There has to be failing government to render large population to to wallow in hunger. So if they people find their own who is willing alleviate hunger and other societal common problems then them have the duty to elect whomever they want.

      Am not afraid to say about 99% of all Kenyan political and some % of the rest of the people’ are entirely corrupt. Kenya have religiously adopted a corrupt system of government. So that at the end of the day we got to see the mean thieves and the generous thieves. So that that at the end of the day the silent mean thief is seem as the right person while the same thief on the other hand who tries donates the proceeds is termed as the “ real thief “.     Great! Why should waititu be allowed to make a mockery of the people while he has already failed one county through corruption, poor management and theft? Kiambu county is still waiting for Waititu to return 580 million shillings which he embezzled with his wife and kids!
