Two suspects charged with the murder of Rongo University student Sharon Otieno alongside Migori Governor Okoth Obado have made a fresh application for bail.
The two, Michael Oyamo and Caspal Obiero, were denied bail by Justice Jessie Lessit in October, but their co-accused Governor Obado was freed on bail.
In an appeal filed on Wednesday, the two want the court to strike out Justice Lessit ruling that denied them bail, arguing that the judge erred and misdirected herself.
The two former Governor Obado’s aides submit that the judge violated their right and fundamental freedom by declining to free them on bail.
In her ruling, Justice Lessit noted that Oyamo and Obiero would intimidate witnesses lined up by the prosecution to testify against them.
“There are compelling reasons not to grant the second and third accused bail at this stage. I find that releasing them may send fear, anxiety to potential witnesses therefore leading to intimidation which may adversely affect the case,” ruled Lessit.
Lessit however released Governor Obado on a bail of Sh5 million with two sureties of a similar amount pending hearing and determination of the case.
The pre-trial hearing for the case is set for February 14th, 2019.
