The High Court in Nairobi has ruled that Independent Electoral and Boundaries Commission (IEBC) commissioners who resigned earlier this year are still in office.
The court said the three commissioners failed to follow the correct procedures when they stepped down four months ago.
In his ruling on Friday, Justice Wilfrida Okwany noted that the trio only tendered their resignation through a press statement instead of writing to the appointing authority.
Justice Okwany made the ruling in a case where a petitioner was challenging the electoral commission’s quorum.
The court ruled their resignation does not affect the composition of IEBC because the commissioners failed to tender their resignation to President Kenyatta. Due to this anomaly, the court ruled the three were still in office constitutionally.
The ruling now clears the way for the electoral agency to carry out the hotly contested Migori senatorial seat scheduled for October 17th.
IEBC Vice-chairperson Consolata Nkatha Maina, Commissioners Margaret Mwachanya and Paul Kurgat resigned on April 17th citing lack of confidence in Chairperson Wafula Chebukati’s leadership.
Their resignation left the commission with only three commissioners namely Chairman Wafula Chebukati and commissioners; Boya Molu and Abdi Yakub Guliye.
