The Director of Public Prosecutions has filed an appeal against the acquittal of Pastor James Ng’ang’a of Neno Evangelism.

Ng’ang’a was cleared in a case where he had been charged with causing the death of a woman in a fatal car crash in Limuru area three years ago.

In a statement on Tuesday, the office of DPP said the appeal was lodged at the Kiambu High Court.

“The @ODPP_KE has today filed Criminal Appeal No. 34 of 2018 at the Kiambu High Court in relation to the acquittal of Apostle Ng’ang’a and four others by a Limuru Magistrate’s Court,” said the DPP’s office in a tweet.

The preacher and his co-accused were facing four charges, among them, causing death by dangerous driving. However, on May 4th, Chief Magistrate Godfrey Oduor, dismissed the case on grounds that the prosecution failed to prove the clergyman’s involvement in the road crash.

The Magistrate said that it was not proved that Pastor Ng’ang’a was the one driving the car during the fatal crash on July 26th, 2015. His car reportedly collided head-on with another car at Manguo area in Limuru, killing Mercy Njeri, a passenger in the Nissan vehicle.

Witnesses said that the preacher was behind the wheel at the time of the accident, but another man by the name Simon Kuria, later claimed he had been the one driving.

Njeri’s husband, Martin Mbugua, sustained serious injuries during the crash. The pastor was also accused of failing to report the accident and giving false information to a police officer.

The crash allegedly involved a speeding red Range Rover belonging to Ng’ang’a and a Nissan March belonging to Njeri and her husband. There were reports that the pastor fled the scene of the accident using a colleague’s Range Rover.

    May Mwene Nyaga forgive those who attend this criminal’s church for they have eyes but don’t see, ears but don’t hear, brain between their nonfunctional ears but don’t think. May this criminal rot in jail but we know it won’t happen. Once he gives the bribe to the right person he will go on taking advantage of the vulnerable adults in his church…sorry enterprise or income generating business.

      Mwororo. It was not the state passing verdict. It was an organ of the state. Which is independent from the state itself.

    This was one hell of a judgement. Lets agree with the judge that the State failed to proof that Ng’ang’a was the driver. But one of the accused stated that he was the driver. Why was he released?
