High Court Annuls Election of Wajir Governor Mohammed Abdi

Wajir Governor Mohammed Abdi Muhamud has lost his seat after the High Court in Nairobi on Friday nullified his election in the August 8th, 2017 elections.

In its ruling, the court said that Governor Muhamud was not validly elected after it established that he was not properly cleared by Independent Electoral and Boundaries Commission (IEBC) to contest for the seat.

In a petition filed by former Governor Ahmed Abdullahi, the court further said that Muhamud does not hold a valid degree certificate as required.

The court further noted that it observed there were irregularities as some of the ballot boxes from polling stations were tampered with after they had been sealed.

Delivering the judgment, Justice Fred Mabeya also indicated that several voters were aided in voting, thereby compromising the integrity of the election and ultimately the results.

The court also found that many election results forms were not genuine; either photocopies lacking watermarks or printouts, with their originals missing.

“In totality, the court hereby finds that the petitioners have succeeded in convincing the court the election was not conducted in a free and fair manner,” ruled Justice Fred Mabeya.

Mabeya ordered a fresh election be held in strict adherence to electoral laws and the constitution.
