IEBC Could Be Forced to Postpone Elections in Some Nyanza Counties

The Independent Electoral and Boundaries Commission (IEBC) could be forced to call of October 26 election in selected parts of opposition National Super Alliance (NASA) strongholds over security fears raised by officials mandated to man election in the areas.

A section electoral officials in Kisumu, Siaya, Migori and Homa Bay counties have expressed fears of insecurity to oversee the exercise following the withdrawal of opposition presidential candidate, Raila Odinga from the race for the repeat election.

NASA leaders have vowed that there will be no election on October 26, and there are fears that there are plans to disrupt elections from their strongholds.

However, speaking after a training session in Kisumu and Homa Bay Counties on Saturday, IEBC commissioner Roselyn Akombe saud the commission plans to provide extra security to their poll officials in the volatile areas.

“I have heard of their concerns over the security situation which is serious and I will be taking them to the commission for deliberation. We will also look at Kisumu and other counties affected to find the best way forward,” said Akombe.

Section 73 of the elections Act allows the electoral commission postpone an election in areas it believes there are serious breach of peace on poll date.

IEBC Chair said the commission had sent commissioner Akombe to assess the situation in Nyanza and give back a report.

“Commissioner Akombe will give us a situational report on Monday (tomorrow),” he said on Saturday.

“I would be lying if I said everything is in order. The truth is a lot needs to be done to guarantee the safety of all our staff across the country,” Dr Akombe said.

“We hopefully shall have had some guidance on how to move forward. We shall definitely have different security measures or arrangements in this part of the country to allow the voters to be able to express their will,” She added.

Returning officers and presiding officers from Nyanza region are said to be reluctant to take up their jobs, while others have asked for transfers to other areas.

Speaking in Makueni on Saturday, former Machakos Senator Johnstone Muthama said that there will be no elections in Nasa strongholds on October 26th.

“From Monday we will continue with street demonstrations, we are against the October 26 elections and we will boycott elections in Ukambani, coast, Western, upper and lower North Eastern, all parts of Homan Bay, Kisumu, Nyamira among other regions”, said Muthama.

    Election is a process not an event Section 14 of the Elections Act is EXPLICIT on the procedure of election. It is as clear as A.E.I.O.U… So this game by Jubilee and their baby IEBC to try and take Kenyans for FOOLS should be rejected. If Dr. Ekuru Aukot is to be gazzetted as a presidential candidate (which is his right) then IEBC requires to adhere to the 21 days provision in LAW and not by the dictates of Jubilee. Effectively, 26th October is untenable in view of the above. That is the Law.

    Most of you here are opined to believe they can interpret the laws with limited knowledge of how a court room works and litigated. While Law is an instrument and prone for binary interpratations, unjust course, the interpretation and intent is to have mutual agreement, just discourse or reasonable accomodations. What I mean there is that the is no perfect Law hence I would discourage most of you interpreting an academic field some of us had to sacrifice 4 years of juris doctoral studies. Any un-corupt constituional Law Justice or attorney would be probable to rule in Favor of Uhuru. He has the votes and for the sake of the country Would Rule in favor of such. Then They would mandate revisions if any. Raila does not have the votes and clearly his intents and motives are morally unjustifiable for a course. It would be reasonable if they can’t agree to rule in favor of whoever is likely to win for the sake and course of the country. Again I do not see Bush vs Algore similarity in Votes there is a wide margin here.,

    It seems to me there are 2 solutions to this problem:1)conducting the election on oct 26th as planned. UHURU will get the majority votes (again).Then all state/judicial agencies i.e.the Kenyan courts,the
    supreme court etc should respect the will of the people and declare UHURU as president. 2)Even though it is a long short .I think that the supreme court of Kenya still has the option of:a) acknowledging that it error-ed in its judgement of annulling the clear win/ will of the people on Aug 8.b)overturn its annulment ruling. c)order a recount of the aug 8th election votes.d)Acknowledge that UHURU legitimately won that election with a significant 1.4M vote margin. e)Declare UHURU as the newly elected president of Kenya.Then Kenyans regardless of their tribe can move on with their lives in peace.We all need a break from elections for the next five years.

    It’s not fun at all to even think about postponing elections!

    It’s about every poor Kenyan who is suffering as a result of politics. For me, I am TRIBELESS. I worry about ever Kenyan who is sweating protesting for their rights. Kenya is a third world country where no one can say “It
    s my right” For me, I can’t go on the streets rioting or protesting for justice in Kenya. I am currently busy working on my Bread and Butter. I wish people can just focus on their lives. Honestly, we will not see these politicians once they get into power regardless of Tribe! If Nyanza people don’t want to vote, they can stay. They don’t have to stop functionality of a country. People are already suffering in Businesses!!! The Economy is becoming so poor and WE HAVE BECOME A LAUGHING STOCK BY THE REST OF THE WORLD. WHY GET SO DIVIDED JUST DUE TO POLITICAL STUFF.     @Doreen and her kind, you celebrated on September 1 when CJ Maraga and his cohorts incompetently and corruptly nullified a clear victory of Uhuru and overturned the will of the people on very flimsy and elementary grounds. Then, NASA leaders and their brainless goons claimed that the Supreme Court followed the constitution in ordering a repeat presidential within 60 days as stipulated in the constitution. Now, the same people who celebrated Supreme Court victory as being constitutional, foolishly want the October 26 election postponed for another 90 days in clear violation of the constitution and Supreme Court majority ruling. These NASA leaders, particularly the coup hungry Raila, and their brainless followers have clearly proven beyond any reasonable doubts that he/they don’t have the interests at heart. But they can’t have it both ways — have their cake and eat it too!

    Every willing voter should not be denied the right to do so. Raila should stop using Kenyans to attain his goal . IEBC can ask backup from the military to make sure that willing voters are assisted to choose their candidate of choice as well protecting the officers
