Wetangula On Who Will Take over From President Uhuru if Repeat Election is Not Held Within 60 Days

Bungoma senator Moses Wetangula says that the country is staring at a constitutional crisis should the Independent Electoral and Boundaries Commission (IEBC) fail to conduct the repeat presidential election within 60 days as stipulated in the constitution.

The National Super Alliance (NASA) principal maintained that President Uhuru is a lame duck president, adding that he will cease being the President if the repeat election is not held within the constitutional timeline.

Wetangula said that, if that happens, National assembly Speaker Justin Muturi will take over from President Uhuru as a caretaker President, until the country is ready for a presidential election.

On September 1st, the Supreme Court of Kenya nullified President Uhuru Kenyatta’s victory thus subjecting him and opposition leader Raila Odinga for another poll within 60 days.

Although the electoral commission has set October 26th as date for repeat poll, NASA led by Raila have maintained that it will not allow elections without certain terms.

Wetangula hit out at Attorney General Githu Mwigai, who on Friday said that President Uhuru has full constitutional authority, and that Uhuru would remain in power if the repeat election is not held within 60 days, until another elected President is sworn in.

“I was disappointed to see Githu Muigai misleading the public. It clearly shows that he doesn’t read the constitution,” he said, in reference to Muigai’s sentiments that Uhuru will still be in charge.

He added:”Careful interpretation of the constitution clearly shows that speaker on the National Assembly will take over for 90 days ahead of another repeat poll.”

Githu said the constitution, cannot allow anyone to set government without its provisions, adding that the sitting president will be in charge until a new one takes over.

Senior Counsel James Orengo on Saturday also bashed Muigai, accusing him of reading the constitution upside down.

“Githu he is using a Chinese law book instead of Kenyan law book. After 60 days, Uhuru will not be in office as president of Kenya. Githu has read the law upside down,” said Orengo.

Milking the SC judgement for all it’s worth. The finality of a losing in credible election is worse than anything else they can engage in, and they know it.

    Your plan NASA will fail. The constitution says elections must happen in 60 days but Raila has been attempting to hinder that. That is contempt of the court. There will be elections. You want to steal, you thieves but we will stop you. You have to get to a point to throw away the constitution.
