State House Digital Director Dennis Itumbi could find himself in trouble over tweets and posts that Supreme Court judge Isaac Lenaola terms as defamatory.
In a letter, through his lawyer Donald Kipkorir, Justice Lenaola has threatened to sue Itumbi if he does not delete the tweets within three days and apologise to him.
In the letter, Lenaola says he would file a defamation case seeking to be awarded punitive damages and use the award until he retires at the age of 70.
Judge Lenaola has further written to Standard Media Group to demand an apology over a story the newspaper published on September 19th, claiming that he contacted some opposition lawyers and agents during the hearing of the presidential petition that culminated to the nullification of President Kenyatta’s victory.
The petition was lodged at the apex court by National Super Alliance leader Raila Odinga.
The judge accuses the the paper of publishing the story before the petition to remove him from office was filed by Derrick Malika Ngumu of Angaza Empowerment Network.
He threatens to move to court and seek compensation, equal to estimated salary for the remainder of his term, which is about 20 years.
Lenaola was one of the Supreme Court judges in majority decision which invalidated the August 8th presidential election.
The Judge also wants Kenya’s giant telecommunication firm Safaricom to confirm whether it indeed provided call-logs to Mr Ngumu, or whether any other third parties accessed information in his mobile phone.
