Nyeri Town Member Parliament Ngunjiri Wambugu has filed a petition with the Judicial Service Commission (JSC) in a bid to oust Chief Justice David Maraga.

Speaking outside the Supreme Court on Thursday moments after filing the petition, Wambugu noted that he seeks to challenge Maraga’s tenability.

“I am challenging how he has conducted himself since he was appointed to the Supreme Court. He has allowed Judiciary to be taken hostage by individuals,” the Legislator stated.

In the 14-page petition, the MP accuses the CJ of “gross misconduct” and wants the Judicial Service Commission, the employer of judges and magistrates, to probe the conduct of Maraga since his appointment as CJ.

He further accuses Maraga of instituting “a judicial coup” as the head of the third arm of government and that he has been held captive by a group of NGOs who have been campaigning against Uhuru Kenyatta’s presidency.

He also alleges that Maraga allowed the non-profits to take over the Judiciary and have been funding a number of programmes, including technical support and training at the Judicial Training Institute.

Wambugu also says that the CJ barred Justice Mohamed Ibrahim from taking in the hearing of the presidential petition filed National Super Alliance presidential candidate Raila Odinga. Justice Ibrahim fell ill on the second day of the hearing of the case.

Justice Maraga, Deputy Chief Justice Philomena Mwilu, Smokin Wanjala and Isaac Lenaola supported the nullification of the election citing irregularities and illegalities in the transmission of results, while Judges Njoki Ndung’u and JB Ojwang dissented.

The CJ did his job based on the evidence adduced and presented infront of the Supreme court of the land. and based on that evidence, it was proven that your click polluted and transmitted fake election results thereby stealing the election. Simply put the Cj applied the FACTS to the Law and his court rulled accordingly.Now you state alot of bogus reasons to challenge the CJ’s conduct all of which do not warrant a response but one, You claim that the CJ would not allow Justice Mohammed to participate in the rulling since he he fell “sick”…. What you should have told your captive audience is that your jubilee bribed mohammed to fall sick so that you only have six Justice members availlable which would have rendered a tie vote of which would revert to mantaining the status Quo that Uhuru would have won the GIG, however the plan backfired because one of the 3 Justices in jubilee bag refused the HONGO at the eleven hour hence you are where you are now.     there was no evidence in this case. and there was it does not take 21 days to reveal it after judgement. There were only few clerical errors which does not call for repeat elections at an staggering cost of greater than 25 billion. That’s not placing the country like Professor Saitoti Said before individuals. This emotions related to Uhuru or Raila must stop. Taxpayers are the once suffering. Maraga we all know gave verdict based on political divide or was trying to think he will be famous and go down in history however I doubt that. Not when Sorphron morpho provided evidence that there was no way election was hacked. I honestly feel pain for the common mwanachi who has no healthcare, education, food and all the basic needs in need while we squander money stupidly to gratify egos of the two candidates while the supreme court gets sucked into nonsense. I support the effort and this justice must be taken out Soonest Possible. He failed to place the country before this stupid elections

    The Chief Justice indulged himself into politics; he should have anticipated the resulting controversies. All the same, we learn through mistakes. Using hindsight 20/20, certainly Maraga is probably second guessing his decision. However, history tells us jurists make errors in decisions. Damage is already done and we should just move on instead of just getting stuck in the past.

    @Mukono. People all over the world will remember that the MARAGA court stole the vote from the ordinary mwananchi. So when people talk about the MARAGA court it will be in the list of shame.Because Maraga has allowed himself to be used to carry the dirty water for those that seek only to destabilize the country. We really do need supreme court reform in Kenya(probably after the rerun is done).This disgrace and injustice cannot be allowed to happen again in Kenya.

    I cant believe that a chief justice would tell judges to ignore law and procedural technicalities. Every judge is independent in their court room.. He should really be taken out..Bure kabisa
