Supreme Court Judge Mohammed Ibrahim will miss pat of the Presidential petition hearings after falling ill. Chief Justice David Maraga on Tuesday morning excused Justice Ibrahim from the proceedings, saying that he was under doctor’s care after falling sick.
Ibrahim is on the seven-judge bench of the Supreme Court hearing the presidential petition filed by National Super Alliance leader Raila Odinga, seeking to overturn President Kenyatta’s win in the August 8th General Election.
President Uhuru Kenyatta’s legal team began making their oral submissions on Tuesday morning to defend his victory and ask the court to uphold his re-election.
President Kenyatta’s legal team led by lawyers Fred Ngatia, Ahmednasir Abdullahi and Ken Ogeto will have three hours to argue for the dismissal of Raila Odinga’s case.
The Law Society of Kenya (LSK) and Attorney General Githu Muigai will each have 20 minutes to argue on points of law, once Kenyatta’s team is done with their submission.
At 5 pm, a team appointed by Registrar of the Supreme Court to scrutinize the electoral management system will present a report to the court.
Ibrahim’s absence will not affect the hearings, since the law requires that five judges out of seven can constitutes a quorum that can listen to a petition.
Chief Justice David Maraga, his deputy Philomena Mwilu, Justice Njoki Ndung’u, Smokin Wanjala, Isaac Lenaola and Jackton Ojwan’g are other judges of the court.
