Conditions for Visa-Free Entry Into Kenya

To facilitate the implementation of a visa-free directive, the government has made significant changes to the Citizen and Immigration Regulations, 2023.

On January 2, 2024, a special notice was released by Interior Cabinet Secretary Kithure Kindiki, notifying the public of a change in terminology. The term ‘Visa’ will now be replaced with ‘Electronic Travel Authorization’ (ETA). This alteration introduces the implementation of a new system known as Electronic Travel Authorization (ETA), which aims to streamline the process of pre-screening for all individuals wishing to enter the country. As stated in the notice, individuals are required to submit an application for ETA through the electronic portal available at www.etakenya.go.ke and obtain the necessary authorization prior to their intended journey.

Form 22 of the First Schedule contains the necessary details for the application, including personal information, itinerary, and any other relevant information requested by the Director. A clear statement is made in the notice, emphasizing that airlines must not permit passengers without a valid ETA to board their flights. Non-compliance with this regulation may result in carriers or agents in charge facing an administrative penalty of $10,000 as specified in regulation 16 C.

It is important to understand that possessing an ETA does not guarantee automatic admission into the nation as the government retains the power to deny entry for violations of regulations. Airlines are obligated to furnish immigration officers with passenger particulars, which will then be verified for authenticity. Misrepresenting information is punishable by a fine of Sh1.57 million. To identify potential wrongdoers or individuals of concern, the immigration department cross-checks the provided data with various watchlists.

During last year’s Jamhuri Day Celebration, President William Ruto delivered an important message. He joyfully declared that as of January 1, 2024, Kenya will adopt a free-visa policy for all global visitors. This momentous announcement, made on behalf of the Government of Kenya, marks the country’s new status as a visa-exempt nation.
