US-based Kenyan scholar Professor Makau Mutua has reacted to Monday’s Supreme Court decision that upheld President Uhuru Kenyatta’s re-election in the October 26th repeat presidential election.
Mutua, a fierce critic of President Uhuru Kenyatta and the Jubilee administration has in the past refused to recognize Uhuru as President of Kenya, and it seems his position has not changed.
“I don’t recognise Uhuru Kenyatta as president. I can’t and I won’t,” he said in the past.
In a tweet on Monday after Supreme Court upheld President Uhuru’s reelection, the New York-based lawyer said that the ruling does not legitimize Uhuru’s Presidency.
“Legality isn’t legitimacy,” Mutua said via twitter.
Mutual joins longtime advisor of National Super Alliance (NASA) leader Raila Odinga’s advisor Salim Lone, who in a statement on Monday on behalf of Raila said that the verdict by the apex court does not change the opposition’s stand on President Uhuru’s legitimacy.
“We in NASA had repeatedly declared before this Supreme Court ruling today that we consider this government to be illegitimate and do not recognize it,” Raila said through his adviser Salim Lone in a statement.
“As such, the court’s decision today could not possibly legitimise an illegitimate government whose president had publicly accused the court of having carried out a ‘coup’ by annulling his election and threatened to ‘fix’ the justices once he was back in power,” Lone added.

Mr Makau Mutua, you are a lawyer and a scholar. You celebrated the first Supreme court ruling because you, of all people understood the law. Why did you agree with the court in the first ruling ? Because the law stood in your favor.The supreme Court judges referred to the Constitution (law) then. When the supreme Court made it’s decision the second time, it referred to the same constitution. As a professor of law, you should not choose when to apply the law and when not to based on personal taste. That is not the law. You should be in a position to uplift the supreme Court decision in both instances as you are a lawyer and therefore a mirror image of your profession;or as a lawyer tell us the merits and demerits of the court ruling .Tell the court where it errored so it can learn and make improvement and so we as Kenyans can also learn. In fact in the process quote some cases to support your argument otherwise your comments about an individual and in this case our President are useless.
