Court Upholds Firing of JKIA Guard Who Ordered CS Matiang’i to Queue for Security Check

A security guard who was sacked for directing Interior Cabinet Secretary Fred Matiang’i to queue for a security check at the Jomo Kenyatta International Airport (JKIA) in 2017 has lost a case against her former employer.

Daizy Cherogony, who was fired following the April 5th, 2017 incident, sued the Kenya Airports Authority (KAA), saying the sacking was unlawful and demanded a compensation of Sh2.4 million.

In a ruling on Tuesday, Justice Nzioki wa Makau dismissed Cherogony’s case saying the disrespect she showed Matiang’i, who was in charge of the Education Ministry at the time, was a justifiable reason for KAA to terminate her employment.

“She was heard in terms of Section 41 and her rights under Article 41(1) safeguarded. Since there was cause for the dismissal and basis for summary dismissal on account of gross misconduct, the suit is only fit for dismissal,” the Judge Nzioka ruled.

In court papers, Cherogony submitted that she did not violate any regulations and procedures laid out by KAA by asking CS Matiang’i to line for security check. 

However, KAA argued that she was supposed to be disciplined, respectful and courteous to travelers, adding that her actions led to the delay in departure of the flight by over 30 minutes.

    As someone who has experienced similar mistreatment, I don’t have any sympathy for her. I was once deliberately delayed by a security guard at an Airport. My pleas that my flight was about to to take off fell on deaf ears. She did not even want to look at my boarding pass. I ended up missing the flight, and spending the night at the Airport. And when I finally arrived at my destination, I had to look for my luggage, which had come with the original flight. Again, no sympathies.

    What was the context of her asking Matiang’i to queue? Did she know it was him? Was any supervisor around to give directions about a potential visitor from the government? I feel like she was just following protocol. What kind of harm did he undergo?? Really.

      Queing. Politicians don’t que or get stuck in traffic. She should have known and is very lucky all she lost was her job wasn’t shot on the spot.

      Security can only delay you if you are carrying forbidden goods . the nasty people are the customs .

        Oh yes, flights do leave without a luggage owner. After they announce on the overhead speakers and you do not stop at any boarding gates to respond, they will take off. Your luggage will be taken to your final destination.

        The luggage always board before the passenger and many times luggage can arrive after or before your flight. Sometimes the security there is so mean that you wonder whether you are in your own country.

      @mteja,you have valid questions.She honestly may not have known who he was.Besides that,Itruly dont think that queuing is showing disrespect.We all queue from time to time.
      If Matiangi does not want to queue, he can have his own private jet.
      Give her her job back.We are all important. Its is this kind of attitude that makes our politicians act like demigods.Shame on the airline.

    Matiangi is just suffering from Big Man Syndrome, that’s all. She just followed protocol and she did not know him. Even if she knew him, so what?

    There is a group of people called government official and VIPs who command special treatments. Protocol or no protocol, there was Government and KAA business at stake. The lady could have been overtaken by the political and media whirlwind of the time, but at the end of the day she forgot that KAA cared for the bottom line not her heroism in opposing a Government official. BTW, the officials use diplomatic passports which have distinct color and I believe Mantiangi’s name was also spelled out correctly. I would also have fired her.

    so stupid, she did what she was hired to do and the stupid politician acted like they do and wanna bypass everything as if laws don’t apply to them. stupidity at its best and the judge is an ass too!

    Matiangi is like that lady justice baraza who took it upon herself to discipline a security guard when they attempted to frisk her.Chances this security guard did not know who he was she was following orders.Unfortunately since Matiangi is now Uhuru’s wingman he will flatten all and sundry who dare oppose him.What is 30 minutes delay for a flight it is not like he was a surgeon on his way to perform life saving surgery .Some hot shot lawyer should take up this case pro bono and represent her if appeal is an option.Power corrupts absolute power corrupts completely

    I think Matiangi was looking for trouble . He used the commoners gate and refused to identify himself or call for a senior person I don’t believe he would have been that patient if he was not being nuisance hope he is now happy he won and the girl lost her job

    The lady acted like a school head girl,delaying a government official and demanding him to follow such procedures as ordinary citizens was a breach of policies, I bet he should have slapped the hell out of her instantly but God forbid this days cameras and laws have changed everything, times of Moi she could have ended up sleeping on tree tops at night in fear of her life. Good she lost the case, sometimes they should learn when to leak the shoes of their employer coz sometimes same shoe may kick their ass where it hurts most
