Supreme Court Allows Admission of Evidence filed Out of Constitutional Deadline in Presidential Petition

The Supreme Court has allowed admission of all evidence in the presidential petition filed out of constitution deadline in the case filed by National Super Alliance leader Raila Odinga.

The admission sets the stage for a titanic battle between President Uhuru Kenyatta, opposition leader Raila Odinga and IEBC legal teams.

Cognisant of the criticism on the manner in which the Supreme Court threw out Raila’s 900-pages evidence filed out of time in the 2013 presidential petition, the Supreme Court judges appeared to take a soft stance on late submissions.

IEBC and President Uhuru Kenyatta’s legal teams had opposed the admission of volumes of documents filed beyond the deadline by the petitioner.

The judges also allowed presidential candidates, Dr Ekuru Aukot and Prof Michael Wainaina, to join the case as interested parties on the basis that the outcome of the petition would affect them.

Nairobi lawyer Charles Kanjama, the ICT Association of Kenya, Isaac Aluochier, and Benjamin Barasa’s attempts to be enjoined in the case were rejected by the judges.

The Law Society of Kenya and the Attorney-General were admitted as friends of the court, but were instructed to limit themselves to specific issues and were told to take 20 minutes each during the hearing.
