Court Orders Gov't to Reinstate Orengo, Ndii and Wanjigi's Passports

High Court has temporarily lifted government’s decision to suspend passports of seven National Super Alliance (Nasa) leaders among them strategist David Ndii, Siaya Senator James Orengo and businessman Jimmy Wanjigi.

On Monday, Justice John Mativo ordered the leaders be given back the travel documents pending the hearing of a case where they are challenging the government’s move.

Other opposition leaders seeking restoration of the passports include; political scientist Dr. Adams Oloo, Raila’s lawyer Paul Mwangi, Dagoretti North Member of Parliament Simba Arati and Henry Mien, a member of the Nasa strategy team.

Immigration Director Gordon Kihalangwa and Interior Cabinet Secretary Fred Matiang’i have been listed as respondents in the case.

In their petition lodged at the Milimani Law courts, the seven argue that the decision to suspend their passports is “unreasonable, grossly heavy handed and unjustified in an open democratic society.”

“Our rights and freedom including association, expression and equal protection of law and right to a passport have accordingly been grossly infringed and threatened without lawful justification,” reads the petition.

Government allegedly withdrew the passports due to their involvement in the swearing in of opposition leader Raila Odinga.

    This courts will soon be just a joke. Government Stand your Ground. This jokers can’t have all the justice and judiciary in their pockets. How can people be engaged in treason affairs and expect everything to be ok. Never saw courts so corrupt .. Bure kabisa., They all should be in jail and here you are working against Government.       Maraga is now the de facto ruler of Kenya. He has rendered the government of President Uhuru and his Deputy Ruto useless by using Judiciary to advance opposition interests. Maraga need to be stopped!!!.

        I agree with you haswa. Maragas mission is to frustrate uhuRuto in all their endeavours and that is why there is so much court activity to “solve” disputes that gova can’t do much about NASA hooligans.Maraga is not interested in fighting corruption in Kenya but being bestie of NASA. They(uhuRuto) should continue ignoring these court orders and continue serving people’s interest the best they can. Judiciary is currently hijacked by opposition.

    Lest you all accuse me of being a flip flopper, I will be clear I am team Uhuru anytime, but, why don’t we call out the elephant in the room? So here I go. I oppose taking away travel documents from anyone unless they are a national security risk. Now, the above mentioned have been accused of undermining the government and we have prove they have indeed done so (swearing Raila in). So the question is, why not arrest and charge them if they are indeed such a risk? Why skirt around the subject whilst it snowballs every minute? As it stands, I am beginning to think that the real enemies to Uhuru’s admin is not the obvious one (NASA), rather, it is the wolves dressed as lambs around him, for the ill advise they are dispensing is suicidal and serves to play right into the hands and agendas of NASA. Period. I am beginning to feel embarrassed by our government. We are waking up to the same old tune every morning and going to bed with the same. Man up or check out. There! I have said it, now come for me if you must, but give me facts that will dismantle my analysis! I am not shy of eating humble pie if I must, lakini this drawn up drama is doing my head in!

    The NRM/NASA goons are willing to disrupt, destroy the livelihoods of many Kenyans, but when their person is touched, they scream democracy is at risk and run to their former classmates in courts, who are more than willing to undermine the employer, the Kenya Government. The courts in Kenya need a revolution. Maraga and his activist Masons should be overthrown.

    The government should ignore those court orders until these judge behave. If those judges know that they make a mchenzo judgment it will be ignored they will put their acts together.

    When will this Jubilee govt understand the concept independent and impartial judiciary.Govt cannot just act the way it wants .It will be cut down to size .Nothing personal but part of the role of the Judiciary is to “oversee” the executive.This Jubilee govt needs babysitting big time Kila saa ni kuoverstep na kuovereach tabia ya kunyanyasa opposition.Why act surprised when most if not all of your actions are getting reversed by the court watu wamechoka and we are past the times of dictatorship.
