The High Court on Wednesday approved the deportation of four Chinese nationals accused of caning Kenyan workers at a Nairobi restaurant.

This came after the four; Deng Hailan, Chang Yueping, Ou Qiang and Yu Ling on Tuesday told the court they were ready to be deported back to their country. 

In an application filed through their lawyer Abdulhakim Abdullahi, the four suspects said have been suffering in detention and requested to be deported.

Consequently, High Court Justice Luka Kimaru on Wednesday directed the implementation of a deportation order that had been signed by Interior Cabinet Secretary Fred Matiang’i on February 13th.

The Directorate of Criminal Investigations (DCI) on Tuesday opposed the suspects’ bid to be deported, terming it an abuse of the court process and an attempt to defeat justice. The DCI asked the court to dismiss the application and allow the case against the four to continue.

“The investigations against the suspects is ongoing and critical since we are still pursuing the employer /owner of the hotel who has since gone into hiding having learned of the arrest of the suspects,” the DCI said in an affidavit.

On February 13th, Principal Magistrate Hellen Okwany allowed police to detain the four for 15 days for investigations to be completed. Hours later, CS Matiang’i signed a deportation order for the four but the order was suspended by Justice Kimaru on February 19th after the suspects challenged the removal.

The four were arrested after DCI sleuths raided Chez Wou Restaurant in Kileleshwa, Nairobi on February 9th. The raid came hours after a video clip showing Hailan, a chef at the restaurant, whipping a Kenyan waiter went viral on social media. 

After the arrest, it was discovered that Hailan did not have a valid work permit. Yueping and Qiang, who are both chefs at the restaurant, were holding expired visas while Yu Ling, a cashier, was holding a visitor’s visa but without a work permit.

They were all facing charges of assault and causing actual bodily harm.

    This should not be allowed to happen. No other country would consider deportation as punishment for crimes commited. Deportation after punishment. Another chines will be flown in to cane kenyans after all the only punishment is a flight back home payed for by kenyans. How is that justice. Matiangi is a sellout.

    Let them be tried. They want the easier way out (deportation) because they might be able to turn-around and come back.
    The best lesson is for them to have a taste of our prisons… Let them be a lesson to others who are allover in Kenya.

      I totally agree, the should serve jail sentence and then deportation to follow.make them learn we have laws an the should be followed. they nee rehabilitation/ correction by sentencing not just deportation.

    Many here stated they need to b deported when this nonsense happened but now the gava have acted to deport the black kenyan wazungus in diaspora have started yapping why deport them???No wonder king kaka sang “wanjinga sisi”.Deportation is very serious in every country n it works perfectly.Look what happening in states when Trump ordered ice to start deporting.Majority od my freds who don’t have papers in states r leaving in fear everyday.Deportation is very scarely my pples??

      Oh deportee, you’re back. When I was a boy, caning was part of some sentences. For nyangaus like this, a thorough hiding would soften his back end for a long painful flight home. BTW you have never shared details of your flight. Give us details include service, in flight entertainment, meal service etc. Also did you clap when you landed? I hear it’s a thing now.

    They should be fined for the number of days they overstayed,jailed for working without a valid work permit and then later after paying their fines and serving jail term they should be deported without any possibility of coming back and their passports stamped so that they may not be allowed to enter into another country.

    Stamping “deportation” means little as another passport can be acquired. And Kenyans please stop this BS of clapping when a KQ plane lands. Let’s leave that primitivity to Ethiopians(they clap when ET lands).

    How would you know that Kenyans clap were you deported and too ashamed to clap how do you know what happens in Ethiopia
