Court Orders for the Immediate Release of Miguna Miguna

The High Court has ordered for the immediate release of National Resistance Movement (NRM) self-proclaimed general Miguna Miguna.

Miguna is reportedly being detained at an undisclosed location at the Jomo Kenyatta International Airport (JKIA) in Nairobi following the botched deportation attempt on Monday night.

Issuing the orders on Tuesday afternoon, Justice Roselyn Aburili directed that Miguna be brought in court on Wednesday.

The release order was granted after Miguna’s lawyers, John Khaminwa and Nelson Havi filed an application on Tuesday, seeking his immediate release and unrestricted right to reenter Kenya.

They further sought orders blocking the Immigration Department from deporting Miguna. The former Nairobi gubernatorial aspirant has been at the airport for over 24 hours, since arriving on Monday at 2.30pm.

“The petitioner is currently being detained incommunicado in a toilet at Terminal 2 at Jomo Kenyatta International Airport on Nairobi,”Court papers by Miguna’s lawyers read.

“The respondents have unlawfully seized the petitioners Canadian passport in a clear attempt to have him declared stateless and continue to violate his fundamental rights and freedoms,” they add.

Interior Cabinet Secretary Fred Matiangi, Inspector General of Police Joseph Boinett, Acting Director of Immigration Joseph Munywoki and DCI boss George Kinoti have been listed as respondents in the case.

Miguna is just a token being tossed around by his so called lawyers, just to be dropped as soon as it suits them. Personally, I would not be surprised if Raila has something to do with this, he can’t stand the guy and could not get out of the airport fast enough according to footage shown so far.

    Facts: Miguna has been accorded his rights and has refused to comply with international laws. b) The Canadian consulate were drawn in to represent him and he would not have it. He is sitting holding everyone ransom. The government has evidence he is Canadian. So, haul his bullying arse right back there, then apply for citizenship. Further, I would argue that his self declaration of coming back to hold a mother of all liberation prove that he has terrorist intentions. Right there, that takes a different twists. Kwani ma lawyers were Kenya wako wapi? He is taking the piss and the immigration department are massaging his inflated ego, c’mon now!
