Miguna Miguna Files Petition to Challenge His Deportation to Canada

National Resistance Movement’s self-declared general Miguna Miguna has filed a petition at the High Court seeking to have government order that saw him deported to Canada quashed.

Through his attorneys John Khaminwa and Nelson Havi, Miguna, who was deported to Canada on Tuesday last week on claims of being illegally in the country, wants the court to compel Kenyan Immigration authorities to reinstate his passport and allow him to return to the country.

“That a declaration be and is hereby issued that the manner in which the Respondents conducted themselves resulting to the purported cancellation of the citizenship of the Petitioner, revocation and confiscation of his passport and other identity documents and the declaration that he was a member of a prohibited class and a prohibited immigrant and removal from Kenya were done in violation of the rule of law and in direct contravention of provisions of the constitution,” the petition read in part.

Miguna has vowed to use all channels to fight his way back to the country following the dramatic deportation that was preceded by a five-day detention by police due to his involvement in the swearing in of opposition leader Raila Odinga.

“I will challenge all the illegal and unconditional actions by the despots in court starting today (February 8). I have instructed a battery of competent advocates to ensure that the ongoing rogue purveyors of impunity are brought to book,” Miguna had said shortly after arriving in Canada.

Defending its decision, the Immigration department said the former Nairobi gubernatorial aspirant is a Canadian citizen and not a Kenyan, since he had denounced his Kenyan citizenship years back.

Miguna listed Interior Cabinet Secretary Fred Matiang’i, Director of Immigration Gordon Kihalangwa, Inspector General of police Joseph Boinnet and Director of Criminal Investigations George Kinoti as respondents in the petition.

    Khaminwa and Havi are your top legal minds like you have stated huh. Let them do the magic then. I think there should actually be a warrant of your arrest for illegally running for a public office as a foreigner.
