Mildred Mtwana, a resident of Kilifi County, has initiated legal proceedings against Daystar University, claiming that they unlawfully shared her pictures without her consent.
Ms Mtwana is pursuing legal action against Daystar University as detailed in her appeal filed with a Malindi court. Specifically, she is seeking compensation of Sh 3 million in addition to an interim injunction that would halt the university’s exploitation of her image for their financial gain. Through her lawyer Shukran Mwabonje, Ms Mtwana raises suspicions of her photograph being utilized by Daystar for selling and promoting their overseas learning products. The university overlooked the fact that Ms Mtwana was not affiliated with Daystar in any capacity – whether as a learner, faculty, employee, or servant – when they posted her image on their social media channels on August 7, 2020. Regrettably, the university continues to showcase her image online without her consent.
Mildred Mtwana has filed a petition in which she contends that Daystar University has used her image rights for commercial gain without consent. She denies granting the university permission to use her image. To redress the breach of rights, she seeks monetary compensation citing that the university’s use of her image subjected her to online mockery and humiliation. Mildred Mtwana has made multiple unsuccessful attempts to contact Daystar University regarding the removal of her photos. In light of this, she has decided to pursue legal action in order to seek compensation.
Meanwhile, Daystar University co-founder Faye Smith has passed away after a prolonged illness. According to an official statement from the university, Faye Smith passed away at the age of 95. She is remembered as a vibrant individual with a passion for preserving knowledge. The statement from the University details that a funeral service will take place at the Main Campus Amphitheatre on Saturday, October 14, 2023, followed by burial at the Heroes Corner at 10 a.m.
