Deputy President Rigathi Gachagua’s Sh1.5 Billion Land Case Adjourned

Deputy President Rigathi Gichagua’s land dispute case has been adjourned to March 16th.

Justice Ogutu Mboya on Thursday pushed the case to March 16th after the court was told that the lawyer representing the deputy president is indisposed.

The court fined Gachagua and his company Wamunyoro Investments Sh5,000 for the adjournment of the case, which was to be heard on Thursday.

“The plaintiff shall pay court adjournment fees of Sh5,000 payable to the National Treasury within seven days in default  he shall have no right of audience ,” ruled the judge.

In the case, Gachagua and Wamunyoro are fighting for a Sh1.5 billion property near Jomo Kenyatta International Airport (JKIA) in Nairobi.

They claim former Director of Physical Planning John Michael Ohas illegally obtained a title deed of the said land in December 2019 and registered it in the name of his company Columbus Two Thousand Limited.

Gachagua claims Ohas tampered with records at the lands office in an attempt to rob him of the prime property, which is charged to Equity Bank as collateral for various financial facilities granted to the deputy president at Sh200 million.

He further claims that he has always been the legal and registered owner of the parcel of land and that he holds a title in respect of the same which was issued on June 18th, 2012.

Gachagua wants the court to order that the title deed in possession of the two defendants was obtained fraudulently, irregularly and illegally, hence invalid, null and void.

He is seeking orders to have the Lands Registrar rectify the register in the lands office to cancel all unlawful entries on behalf of the first and second defendants and indicate the plaintiff as the lawful owner.
