Collins Kibet Toroitich, the eldest grandson of former President Daniel Arap Moi has lost a bid to settle a child upkeep case out of court.
Kibet had filed an application before Nakuru Resident Magistrate Benjamin Limo seeking to be allowed to engage Gladys Jeruto Tagi, the mother of his two children, with a view to settling the matter amicably. His lawyer told the court that Kibet was ready to negotiate an out-of-court deal.
“Since my client is willing to take responsibility, I am sure we can sit down with the applicants’ lawyer to come up with proposals on how he is going to support the children,” Kibet’s lawyer told the court.
Tagi, who is demanding Sh1 million child support per month, opposed the application accusing Kibet of being insincere and mischievous. She termed his request as a tactic to delay the case.
The court also heard that despite confirming he is the children’s biological father through DNA, Kibet has not bothered to reach out to Tagi or offer them any assistance.
“He is not the best person for mediation because his actions portray him as a very mischievous person. He comes to court driving a Toyota Land Cruiser V8, takes lunch from one of the high-end hotels in town, and leaves without even greeting his own children in court,” Tagi’s lawyer told the court.
The magistrate ruled in favor of Tagi and ordered the case to proceed to hearing before it is determined by the court. The matter will be heard on February 11th.
