Court Orders Police to Produce Missing Lawyer Hassan Nandwa Within 24 Hours

The High Court has ordered police to produce lawyer Prof. Hassan Nandwa and his client Elgiva Bwire within 24 hours.

Justice Anthony Mrima issued the order on Thursday following a habeas corpus application filed by the Law Society of Kenya (LSK).

The judge further directed telecommunications company Safaricom to supply the court and LSK with Prof. Nandwa’s phone call records.

“I have considered the submission made and I’m satisfied there is reasonable circumstantial evidence pointing out the high possibility that the second and third persons are likely in custody or at least they (police) are aware of their whereabouts,” the court stated.

The judge noted that it was disturbing that the police are yet to explain the whereabouts of Nandwa and his client.

On Tuesday, the National Police Service (NPS) issued a statement denying knowledge of the whereabouts of Nandwa, who was allegedly abducted last week when he Jamia mosque in Nairobi after evening prayers.

NPS said investigations are underway to find the Muslim scholar and bring his abductors to book.

Nandwa’s family believes he is in the hands of police officers following a raid in their home by people who identified themselves as police officers on the night he disappeared. The alleged police officers reportedly stormed the scholar’s home in search of his client.
