Security Guard Sacked for Questioning Lack of Toilets Awarded Sh171,000

A security guard who was fired after asking to be shown where he could relieve himself during night duty has been awarded Sh171,000 for wrongful dismissal.

Johnson Otieno Ogola, a former employee of Hatari Security Guards, had been deployed to Mapara Homesteads located on Desai Road in Nairobi.

After nights of working and suffering because of a lack of washrooms, he asked the owner of the property to show him lavatories he would be using.

Instead, the owner reported him to the management of Hatari Security, claiming that Ogola was rude and unwilling to work.

“He was summoned by his managers in the main office where he was told that he was rude to the client and he usually reported to work while very drunk. Consequently, he was terminated,” court documents read in part.

Ogola sued the security company, arguing that his dismissal was unfair and in contravention of the Employment Act and the constitution.

His lawyer said no notice was issued to him before his termination and neither was a disciplinary hearing conducted.

He also told the court that the company violated his client’s rights as he was receiving a salary of Sh9,000 which is below the statutory minimum for employees in his category.

The court further heard that Ogola was working overtime and the employer had not considered giving him house allowance.

In his ruling, Judge B Manani said evidence tabled before the court was clear that Ogola should be rewarded for wrongful dismissal.

The judge awarded him Sh171,000 including Sh73,303 for house allowance and underpayments, service pays worth Sh11,776, and Sh12,597 as salary in lieu.

    Justice served.I hope that gone are they days when capricious employers ignored labor laws,and fired employees at will.
    This fellow must have had a pretty good lawyer.I say this because if Kenya labor laws are crafted to”match”the like of American contract laws.Then” at will” contract are common as in USA,and they allow the employer to fire without”just cause” and same goes to the employee, he/ she can quit without giving a reason. And of cause there are other contracts that stipulate different clauses,and require reasons to be fired,and terms of quitting.Yes knowledge is power. Employees should educate themselves on their rights,and alawyer’s number in their back pocket.MMmmmm a not so crooked lawyer…

        @ Just curious, I dont know how long you have been on this forum,but last year I took a hiatus for 6 months them came back on in November,I think.
        Anyway, if you can spare 2 hours aday, then you can be on Mwakilishi daily if you chose. After all how long does it take to comment.Its not like doing a term paper.I also dont watch TV. I havent turned on my TV in months. I read instead.Of course,I know how to get the news I want.I have subscriptions on Internet.
        I watch sports from time to time.Used to play in a band.Not any more .So I have time for Mwakilishi,and my Mexican squeeze.
        As for what I do,I am an accountant for a law firm. And do some freelancing.I also dub into small business enterprises.I hope that I have answered.Your questions.

  2. I hope the lawyer does not…
    I hope the lawyer does not charge too much I’m sure he gets a cut from the settlement. Is the former employer going to pay willingly without appealing?
