Interior CS Fred Matiang’i has dismissed claims that the recent arrest of Meru Senator Mithika Linturi was due to his stand on the BBI Bill.

Linturi was dramatically arrested by detectives from the Directorate of Criminal Investigations (DCI) on April 28th while on his way to Parliament ahead of a special sitting where MPs were scheduled to debate a report on the BBI Bill.

Appearing before the Senate Security Committee on Friday, CS Matiang’i clarified that the politician’s arrest was linked to 37 criminal charges he is facing alongside Emily Nkirote Buantai, his co-director at Atticon Limited.

Matiang’i explained that on November 1st, 2018, Nkirote made a report to the DCI alleging that she was a director of Atticon Limited together with Linturi holding 50 and 1,050 shares respectively.

She called for a probe claiming that fraudsters had forged the board of directors’ minutes dated April 28th, 2017 and removed them from the shareholding, and appointed new directors.

On November 15th, 2018, Collins Kipchumba Ngetich, a director of Barons Estates Limited, reported to the DCI claiming that in June 2018, he discovered that the directors of Atticon Limited had fraudulently applied for renewal of an overdraft facility of Sh100 million without his consent.

Upon searching the Companies Registry, Ngetich said he found out that Barons Estates Limited was fraudulently removed from the shareholding of Atticon Limited using forged documents.

 “Since the two complaints revolved around the same personalities and entities, they were consolidated and an inquiry file was opened. The investigations were conducted and all persons of interest were interviewed and 26 statements recorded, documents collected and those suspected to be fraudulent, 33 in number were subjected to forensic examination and results obtained,” Matiang’i told the committee.

On February 9th, the Office of the Director of Public Prosecutions approved the prosecution of the suspects—Senator Linturi and Nkirote—following investigations by DCI.

CS Matiang’i says the two face at least 37 counts of fraud-related charges, including giving false information to a person employed in the Public Service; conspiracy to defraud; forgery; impersonation; obtaining credit by false pretense; fraudulently procuring the registration of a charge document; and intent to defraud.

    It sounds like a civil case involving conmen but one side chose to settle it using the “official” crooks led by jambazi Matiang’i.Hapa the highest briber gets justice through the MBETE & KOOME GANG.

    Matiang’i is busy splitting hairs pretending to be out and about prosecuting for private companies business maneuvers and their tactical dirty games while he has done crap on the gland scale corruption that has swallowed billions of wananchi’s hard earned money- plus billions of borrowed money that generations to come will have to pay. The dramatic arrest of Linturi within the parliament building is reminiscent of Moi’s regime chasing Anguka down the State house building for Ouko Murder oblivious of Nicholas Biwott’s (Moi’s right hand man) open involvement. Matiang’i, Why can’t you dramatically arrest all those who owe us money: Waititu, Waiguru, Evans Kidero, Mike Sanko, Okoth Obado, Ojaamong, Ruto, Raila, Ngilu, Kalonzo, Rotich, governor Moses Kasaine, etc. And to think that out of all these political thievery there has never been a single successful conviction just because they involve the political and economic goons and elites, is mind boggling.

    Wow, 37 criminal charges.Now we await the usual defense of ‘I am not guilty”.The problem with this statement is that those who invoke it never complete it, letting some to believe that they are innocent.They should clarify that by saying that they are not guilty till proven otherwise by the court of law.And yes you can be guilty and walk for lack of evidence against you.Almost like evading justice…
    At least one of the 37 should stick.Meaning some jail term,i hope.

      Mirhika should be in Kamiti as we debate his guilty or not plea! The problem here is that the judicially is simply sleeping on the wheel and such cases as this one takes a long time to be determined.

    Matiang’i is just serving the yes Sir orders for his boss.He too is equally as trigger happy as his boys in blues.Had lot of respect for this tummy guy when he was minister of education. He was a reformer back then but now he just serving execution menu for his boss.

    Matiang’i needs to return to the Education docket and leave the corruption game to the Uhuruto thugs. Education sector needed him, and he should have stayed to save the future of our youth and the country. For now, we have lost him to the , again, Uhuruto cartels. Take it, or leave it. Burger!
