Sonko Arrest: Governors Ask to Meet Uhuru over Looming Power Vacuum in Nairobi

The Council of Governors (CoG) has asked for a meeting with President Kenyatta to address the power vacuum that could be created following the arrest of Governor Mike Sonko on Friday.

Sonko, who was arrested over irregular procurement and payment of Sh357 million, has been running the County government without a Deputy Governor after Polycarp Igathe resigned in January 2018.

Governor Sonko is likely to be barred from accessing his office once he is charged with graft-related charges on Monday, meaning a power vacuum could be created. Kiambu and Samburu Counties are currently being run by respective deputy governors after the court barred Governors Ferdinand Waititu and Moses Lenolkulal (Samburu) from office until their cases are heard and determined.

On Sunday, CoG Chairperson Wycliffe Oparanya said the council wants President Kenyatta to convene an emergency meeting to ensure Nairobi County is thrown into crisis.

“Following the arrest and detention of H.E. Mike Mbuvi Sonko the Council of Governors is monitoring and consulting widely on the unfolding situation.”

“We are however aware of the uniqueness of the County Government and therefore we shall reach out to H.E. the President to convene an emergency Summit to address the evolving situation,” Oparanya said in a statement.

Given that Nairobi does not have a deputy governor, the Speaker of the County Assembly Beatrice Elachi will take over the functions of the Governor as required by Article 182 of the constitution.

However, Speaker Elachi does not enjoy the support of a majority of Members of County Assembly following her impeachment on September 6th, 2018. She has since been reinstated by the court but she has experienced difficulties in controlling the house as a majority of MCAs are against her leadership.

Dissolve the county government and hold new elections if Elatchi can’t function with the law behind her. Uhuru has no place in this situation other than being a resident of Nairobi like the rest of us.

This brings into question how long a county should go without a deputy governor.
