Man Files Petition for Removal of CJ David Maraga, Claims He Conducts Meetings in Kisii Language

A Kenyan has filed a petition at the Judicial Service Commission (JSC) seeking the removal of Chief Justice David Maraga from office.

In his petition, Yusuf Dimbili cites abuse of office and gross misconduct as grounds for Maraga’s ouster.

The petitioner further accuses the CJ of hiring a majority of his staff from his community and using Kisii language to give official instructions.

“…the situation is so bad to the extent that meetings and instructions in the said office are conducted in the ethnic dialect of the Chief Justice…” claims Dimbili in the petition.

“…A human resource audit of the office of the Chief Justice will clearly indicate that 85% of the workforce being drawn from the Kisii community where the Chief Justice hails…”

Dimbili also accuses Maraga of making references to the Wajir gubernatorial election petition judgment before it was delivered. He says the CJ made reference to the judgment during the Laikipia gubernatorial petition ruling.

“The Laikipia petition judgment was delivered on February 8, 2019, and the Wajir petition was delivered on February 15, 2019. This is not only unprofessional but reeks of gross misconduct,” reads the petition in part.

Dimbili further raises questions about Maraga’s presence in President Kenyatta’s political rallies in Kisii and Nyamira counties a few weeks ago.

He also argues that Maraga disregarded the law by endorsing Prof. George Magoha for the Education Cabinet Secretary position even before his vetting by Parliament.

“… he stated that the newly nominated Cabinet Secretary for Education Prof. George Magoha did not need to undergo vetting in order to assume the said office… That the utterances of the respondent regarding the vetting of the nominee is a clear indication of the utter disrespect and disregard of the rule of law. It further displays his partisan and tribal partiality, in that he can do anything for political and tribal interests,” reads the petition.

    Arguments for Maraga removal have no teeth. One needs to proof he hired Kisiis who are not qualified to do the job. The case is frivolous and a waste of time.

    Ni lazima wanasiasa wote wanapofanya mikutano yao hadharani watumie lugha ya taifa – KISWAHILI.

    Kikuyu (government Officials) too conduct Functions in Kikuyu language in Kenya and even Abroad.

    E.g.: In about 2002 or 2002 I attended a University graduation Ceremony for Kenyans in EDMOND, Oklahoma (Oklahoma Central University if I remember very well). Suddenly: This big SHOT of a Kenyan government Official began Addressing us in KIKUYU! (yet gathered there were Kenyans from all Walks of Life). More Insulting was this majuu Kikuyu-Translator (mwenye “Hakujua hajui”). It was a Tribal disaster. It was Shocking!!!

    Then:

    Go to Massachusetts, USA (and we have 1 or2 “Kenyan” churches that conduct Everything in Kikuyu and KIKUYU language only)! Amazing!!!

Kiswahili kwa watu wote wanaotoka Kenya na nchi nyingine za bara la Afrika ambazo zinasema Kiswahili, Kiingereza ninapowasiliana na ndugu zetu Wamarekani ambao kama binamu (cousin) zao Waingereza hawataki kujifunza au kujua lugha nyingine yoyote. Mimi sikuhesabu kama Mkenya kama hujui Kiswahili!

    Yafaa bunge la Kenya lipitishe azimio ya kwamba, ukiwa kazini au unapofanya mikutano yote ya kisiasa, ni lazima utumie lugha ya Kiswahili. Kama hujui Kiswahili, afadhali uhamie Canada, Marekani, Uingereza, Australia, au New Zealand ambako Kiingereza husemwa na kila mtu huko.

    Nimestaajabu kusoma ya kwamba (@imkgoogo na @Romeo) lugha za kiasili hutumiwa kazini. Ndiyo sababu jambo Jubilee ilifanya (kugawana kazi baina ya mataifa mawili kwenye nchi iliyo na lugha 42) lisifanyike tena baada ya 2022.

    Mkenya ambaye anasema Kiingereza peke yake ni “Mkenyareza.” Yeye si Mkenya! Maana yake, ana damu ya Kenya tu lakini kila kitu chote anachofanya kinaambatana na mila, lugha, na dini Waingereza.

    Bagusii ??????? wacha wakisii wakue na mtu wao bana…. Ever since Nyachae senior giving politics a break, wakisii have been running around desperate and more divided. They’ve been used as pawns and dumped by local leaders. CJ Maraga is a big let down. If you are only discovering that today, jiongeze kwa foneni. Some things like nepotism in Kenya will never change. You want change? Start with yourself. Don’t accept jobs or deals from anyone known to you without following the due process. Curb corruption by Not participating in it. It starts here.

      From the get-go, KISIIs (under Gov. Ongwae) are the Tribal(est) Kisiis ever. Even during his tenure in Education: Ongwae would Brazenly hire Kisiis to his Department (from Sweeper, Watchman, Office messeger, etc to Manager). Wow!!!
