Police Impostor Joshua Waiganjo's Case Takes New Twist

The High Court in Nakuru has blocked a lower court from delivering a ruling against the infamous police impostor Joshua Waiganjo.

High Court Justice Joel Ngugi has blocked the ruling against Waiganjo and two others, pending hearing and determination of a case filed by the Director of Public Prosecutions (DPP).

Justice Ngugi stayed the proceedings before the magistrate court after the DPP filed an application accusing the lower court of prematurely closing the case against Waiganjo before the investigating officers testified.

Judge Ngugi has certified the matter as urgent and has directed the DPP to file and serve their application to the respondents in the case.

The DPP argues that the lower court erred in closing the prosecution’s case before its last three witnesses gave their testimonies.

“The office of the DPP is seeking the reopening of the prosecution’s case and allow three witnesses Fatuma Hadi, Gideon Kimilu and Joseph Ngisa all who are Superintendent of police to testify and present exhibits in the matter,” the DPP says in court documents.

He also accuses the magistrate court of being partial in handling the case, stating that the prosecution was denied time to present its witnesses.

The magistrate court was on Wednesday set to rule on whether the respondents have a case to answer or not. The case was closed after 37 witnesses testified.

The matter will be heard on March 28th, 2019.

Ni wasi ya kwamba hii kesi inawahusu mafisi wakumbwa polisini na pongezi na heshima iende kwa DCI venye wamesimamisha hio ukora ndio wachomoe waasi wanaojificha humo ndani.

    This is a typical problem with our reporters. If the intention was to inform, the reporter would’ve informed us of why the lower court was not accepting evidence from these 3. The lower court did not just block the DPP witnesses, there was a reason. The higher court shouldn’t have interfered with the independence of the lower court. The judiciary is killing itself.
