Supreme Court Upholds Election of Governors Alfred Mutua, Martin Wambora

The Supreme Court has on Friday dismissed a petition challenging the election of Machakos Governor Alfred Mutua.

Supreme Court judges have ruled that Governor Mutua was validly elected in the August 8th, 2017 election.

The ruling comes after Mutua moved to the apex court to challenge a decision by the Appeals Court that nullified his election. In its ruling, the Court of Appeal said the results announced by the returning officer failed the Constitutional test and were unverifiable.

The ruling was made following a petition filed by Mutua’s rival in the August 8th election, Wavinya Ndeti of Wiper party.

In a separate case, the Supreme Court has also upheld the election of Embu County Governor Martin Wambora.

The court has ruled that the petitioner, Lenny Kivuti failed to prove his claims that the Embu gubernatorial elected was marred by irregularities.

The apex court has also upheld the election of Alfred Keter as the Nandi Hills Member of Parliament. In their ruling, the judges say that the petitioner- Bernard Kitur- didn’t prove claims of violence, intimidation of voters and voter bribery.

Lastly, the Supreme Court has nullified the election of Ugenya Member of Parliament Chris Karan citing massive irregularities.

The Supreme Court has directed the Independent Electoral and Boundaries Commission (IEBC) to conduct a fresh poll in Ugenya constituency.
