Embattled Migori Governor Okoth Obado will spend two more nights behind bars awaiting court ruling of his bail application.
The hearing of the Governor’s bail application took place on Tuesday afternoon before High Court Justice Jessie Lessit and the ruling will be read on Thursday.
Obado spent the weekend at Gigiri Police Station before judge Lessit ordered he be detained at the Industrial Area Remand Prison when he was arraigned in court on Monday. He is facing charges related to the murder of Rongo University student Sharon Otieno.
While opposing Governor Obado’s release on bail, the prosecution argued that he is likely to use his position to interfere and intimidate key witnesses in the case.
“The release of the accused person on bail pending hearing and determination of the trial is not absolute and is at the discretion of the court,” the prosecution submitted.
The prosecution also noted that Sharon’s family had received threats believed to be issued by Obado’s accomplices and that the three abductors who killed the 26-year-old student are still at large and have evidence which links the Governor to the commission of the heinous crime.
On the other side, Obado lawyers poked holes on the prosecution’s submissions against the Governor’s release.
“The applicant has an unqualified constitutional right to be presumed innocent until the contrary is concluded,” said Obado, in the bail application filed by his lawyers.
The Governor further stated that all his children are schooling and they solely depend on him hence, they will suffer if he’s detained.
“I am the sole bread winner of my family,” says Obado.
