The High Court in Nairobi has declined to nullify the election of Charles Njagua alias Jaguar as Starehe Member of Parliament.

Dismissing the petition challenging Jaguar’s victory on Monday morning, Justice Fred Ochieng’ said the petitioner, Orange Democratic Movement’s Steve Mbogo, failed to present sufficient evidence to support his allegations that the election was marred by massive irregularities.

“I find where there were discrepancies on the vote counts the petitioner has not shown evidence of the said discrepancies. The petitioner didn’t show evidence that there were voters who were not in the KIEMS kit,” said Justice Ochieng’.

Justice Ochieng’ also ruled that the Constituency Returning Officer’s failure to sign Forms 35 A was a minor irregularity that couldn’t warrant an annulment of the election.

The court further failed to find proof of Mbogo’s claims that Jaguar assaulted and ruled that Jubilee candidate was validly elected in an election conducted with strict adherence to the Constitution and relevant electoral laws.

Mbogo was directed to pay Sh10 million; Sh5 million to Jaguar and a similar amount to the Independent Electoral and Boundaries Commission (IEBC).
